Claiming against an organisation or business for vehicle damage

My car was substantially damaged by a falling tree branch, at the moment I’m trying to figure out the best way of dealing with the damage, waiting for repair quotes before deciding weather to make an insurance claim. If I go through my insurance, the total excesses come to £230 and my plan is to try and recover this money from the organisation to whome the tree belongs. AT the moment I cannot get hold of them, I’ve left message asking for them to call me and I’ve also emailed the highways dept at the council because the tree overhangs the public’s highway and I was trying to ascertain wether they had ever previously been told to clip back or remove branches etc, auto email reply says 10 days so won’t know anything about that yet.

Has anyone ever claimed for damage from a organisation or business?
Was it straightforward? I’m guessing they must have public liability but as I cannot claim for that if they are not cooperative I’m guessing I’ll have to go down the small claims route...

If you have legal cover with your insurance they should be able to deal with this for you.

Normally your insurance will claim from their insurance. It is important to note that you should still tell your insurers of any vehicle damage even if you do not claim through them.
