Ebay advice please

Name changed as knowing my luck the seller will be on here

Bought an item on Ebay advertised as "brand new", under normal circumstances if bought in the shop the item would come with 3 additional parts, one of which was in the stock photos the seller used. The item was over 50% off RRP

Item arrives not in original box (didn't bother me but surprised me as advertised as new), missing 2 of the additional parts including one of which shown in the stock photo. Messaged to ask and was told they didnt come with it, happy to accept one was not in the stock photo but the other was.

Messaged to ask them to send it on the part in the photos, they have lost it. The message we got was unapologetic and rather shirty with us for even asking. If they had been apologetic we would have accepted that as it was a bargain and moved on. I asked what they proposed as a resolution and they have said that we got a bargain so should accept missing parts.

Now, if im buying something as brand new i would expect it to fit to the stock photos used. Had the seller been polite I would have just moved on. Am i being crazy to complain to ebay? Will Ebay even care?

You cannot seperately buy the missing parts if that makes any difference

Very aware of this being a minor issue but given that we will in turn sell it on, it has made it harder to sell on for us.

If anyone has complained before to ebay do they just say "well send it back then"?

Open a dispute on eBay. New or used, you didn't get what you paid for. eBay protects buyers over sellers.

You can force them to send you a part they claim they dont have.
Just return it as "item not as described".

I'm having the exact issue right now. Item described as "mint condition" but when we got it and built it up, parts were missing. Having got thr manual, I looked at the photos again and could see that parts were missing from their photo (but I wouldn't have known that without the manual to see what it should look like).
They first said "we sent everything; we checked every piece against the list". Then, when I pointed out the missing pieces in their photo along with all he other missing pieces they have offered to source the missing parts and send them on. its lego so that's fairly easy, but the pieces will.be about 12p each so I can just do that myself. The seller could have carried on saying "nah" and then I would have returned it our of spite tbh, but we will keep it and fix it ourselves as it was a bargain!

@bobbiedraper to be honest if we could source the part (we cant) and have an apology it would have been acceptable to us.

Their argument is we got a bargain, which we would have had all the parts been there but they are not. Its a pain in the arse as i have a newborn so the hassle of sending it back isn't ideal

You didn't get what you paid for. Raise a dispute ASAP.

The photos form part of the sale agreement unless otherwise stated. Sellers like that need to be challenged. Open a dispute for sure. You shouldn't have to be running around wasting time getting parts.

@gingerbeverage if we could get the parts I'd be less pissed off to be honest, the fact they are not able to be sourced is the real pain point
