I've just woken up to the most god awful scratching/scurrying in the attic. Now i know what you're all thinking and i am also thinking this

Thing is, it's a 3 story house and then the attic? How are they up there? Next door has just kicked his tenants out, house was apparently in a disgusting mess and has been slowly sorting out the place and moved in, has the movement and cleaning made them go into out loft?
There is also a bird that is nesting by the window but birds are not nocturnal and do not move that quick.
Not sure what to do as rental agreement says to keep the house clean basically to stop any infestion but doesn't say who is to pay for infestation? House is clean- definitely. Ahhhhhh
