A Quick Will Question

Been trying to get DS2 to make a will.

Our wills leave all to each other then evenly divided between the boys after the death of the second of us. Both DSs have long term partners and neither have any children.

DS1 thinks that if DS2 dies before us we would inherit everything he owns and not his GF. So we want him to make a will. But he won't.

Is DS1 right?

If you DS dies before you, without a will, his estate will go to his next of kin, which would be you if he's childless. It won't go to his girlfriend without a will in place.

Do they own their a house OP? If they do and they're Joint Tenants, then the other tenant will inherit after the other person's death (could be GF). If they're Tenants in Common then the GF will only be eligible to her half share if your DS dies. Of course if they rent then none of this is pertinent.

Thanks. They do own a house together. He really needs to sort this out. Presumably if we're dead his brother will get his estate.
