Will question - any solicitors around?

We've had our wills drawn up and signed them today, witnessed by our neighbours. However, one of the neighbours has spelled his name incorrectly on both wills (but a different mistake on each!). Do you think it is a problem?

I would potentially question the capacity of your witness.

How on earth can anyone misspell their own name - once, never mind twice?!

cuckooken · 01/02/2020 23:29

They spelt their own name incorrectly?

I would want to re-execute them. It could raise questions in the future as to the validity of the wills, particularly if you were both to die at similar times so the discrepancy between the two was noticed.

Definitely redo. With different witnesses.

When he came round, he said the only thing is that his hands are shaky (he is in his 70s). I don't question his mental capacity at all, but I agree this doesn't look good. On one will he duplicated one of the letters in his name, and on the other he missed off the last letter.

Do it again and get someone else instead
