Maternity allowance

Hi , I sent off my maternity allowance application forms about a week ago with my wage slips and MATB1 form and received the text yesterday to save they have received it , I’ve just read something about having to send in a SMP1 form from your employer aswel .. I did not send this in as my employer wouldn’t give me one! Will this matter? As I’ve seen people saying there claim Still went ahead without one ????

The matb1 goes to the employer to claim SMP and they give you SMP1 saying why you don't qualify.

The maternity people may ask for additional info if needed.

Did you check to see if you qualify for SMP?

I don’t qualify for SMP my employer said I haven’t been there over a year! but she refused to give me a SMP form , going to ring HMRC and see if they can do anything about it but MA have already received my forms !!!

You don't need to be in a job a year to get SMP.

HMRC will enforce payment if you are entitled or if employer still refuses (and you are entitled) they may pay you and then fine the employer.

The Employer is legally obliged to issue an SMP1 form that explains what they are denying SMP

Another thing has anyone ever had the maternity grant? How long did it take to process got a message saying give them 21 days now apparently have to wait until after universal credit payment?

After your manager has sent your MATB1 form off with your maternity rights form how long does the decision take wether you can receive SMP ?

How long have you worked for this employer Hannah and are you paid at least £118 a week?

To qualify for SMP you need to have worked for 26 weeks by the time you are 25 weeks pregnant and earn at least £118 per week.

Since April I have worked for her...
since may I’ve been earning around £118 a week until September time when she started to cut my hours as I’m on a 0 Hour contract. I went on the sick in November and haven’t been back to work since I planned on starting my maternity at 29weeks I’m now 30 weeks .. how long after your employer sending your MATB1 form off to the head office can the decision take wether or not I can receive it from my work or the government ????

I roughly calculate you have been off weeks 19 onwards and even if paid SSP you haven't earned enough for SMP.

If you earned £30 or more in any of the 13 weeks you worked for them, you will qualify for MA. If not did you work before this employer?

I believe there is a backlog in applications.

Are you still off sick or have you started your maternity leave and informed your employer?
