I've been served an Enforcement notice - confused.

Just opened today's post and, in my name (but with next door's address), I've been sent an enforcement notice served under Section 46 of the Environmental Protection Act, 1990.

It says that I've been served this notice because the Council have evidence in my name found in waste removed from the rear of a large road in my nearest town on the 30th of October.

I'm really confused. I have no idea what this means or how this happened. I'm not a litterbug - am the exact opposite.

I teach in the nearby Comprehensive but this is about 1 mile from where the 'evidence' was found.

I've googled maps and I don't recognise the road so it isn't one on my route. I may have used it recently because I got tangled up in the one way system in that area, got lost on my way to somewhere because of a diversion, but am pretty certain it wasn't on that date, plus I didn't stop or get out of my car.

The only thing I can think of is that I've cleaned my car - the usual routine of grabbing scraps/wrappers from my car and binning it in the nearest bin I can find - but even then, I never dump it- I always, always always bin it safely.

The letter doesn't actually tell me what I have to do now - it includes a reminder of how to dispose of waste and a calendar for kerbside collections and recycling for my area.

A third bit of paper tells me how to appeal and whether the court will either quash or modify or dismiss the appeal.

I AM TOTALLY BAFFLED and just a little stressed about this. I've rang the Council telephone number, but of course, there's no one there this morning.

Has anyone come across this?

I know people say "It's not me Gov, I'm totally honest" but honestly, I recycle everything I can, keep a bag in my car for rubbish, I've been known for reporting other cars who bung stuff out their window to the non-emergency line.

This has been a strangely illuminating and troubling thread op ! Who knew emptying car rubbish into public bin (street not car park!) could be an offence.
So glad you have sorted it out.

I'd be more worried about the 'admin error' that could have led to prosecution for someone who wasn't even responsible.

Is that a gdpr breach? Because they’ve now basically told you your neighbour has dumped rubbish.

Stupidriver1 - apart from the fact they've said no such thing. He too may be innocent and be able to prove it, the fact that they got the details wrong the first time means they may have got them wrong again, and they didn't say they were now going to send a notice to the neighbour instead. They didn't even tell the OP what her neighbour's name is or what his job is - she told them that, so she was the one giving away data, they just gave away that they originally thought she was the one who dumped it and now, thanks to her information, think they made an admin error.

I was in a position where I had to give information to verify my position in this misunderstanding.

It IS worrying though that people are wrongly blamed.
