After some advice..I'm currently on maternity leave from work..I've had my 9 months paid and I'm unable to go back so I don't know what my next step is? Do I have to inform them..am I going to have to pay money back? I have no idea and it's really stressing me out 😕

Have you been getting statutory maternity pay or have you been getting an extra maternity pay from work? If you have just had statutory you won't have to pay anything when you leave. Just ring or email your employer and inform them of your decision

I'm guessing it wasn't just statutory maternity pay?
You do need to inform them - your normal notice period still applies.

If you only got statutory maternity pay (90% for 6 weeks, the rest at £148ish per week) then you dont need to pay anything back. You need to give your usual notice period to resign

It depends on the company. Even if you got an enhanced package (ie full salary for 6 months as an example), lots of companies don't require it to be paid back. You need to check your contract and make sure you give the correct level of notice.

It depends on your employer policy. You need to check your handbook.

As others have said what pay did you receive whilst you were off? When you say "9 months paid" do you mean your SMP or have you had enhanced company maternity pay on top of that?

You can take up to 12 months maternity leave, are you talking about extending 9 months to 12 or never going back?

Your notice period still applies so if you aren't intending to ever return you will have to give notice just as you would if you were working.

If you have received company maternity pay on top of SMP then some of it may be repayable. My contract of employment allows for enhanced maternity pay but if I don't return to work for at least 3 months after the end of my maternity I have to pay that back (the money I have had over and above SMP). So that would depend on your contract - also check staff handbook if not in contract itself.

I've only been receiving statutory maternity pay, so all I have to do is hand my notice in then I think

Unable to go back due to them or you?

Check your contact ASAP.

Yeah that's fine - just hand in your notice, you don't owe anything!
