Urgent - does anyone work in car finance

My feckless husband has managed to not pay his car finance for 3 months. He changed over his direct debits to a different bank account and didn't check it had all been set up correctly.

He then totally failed to open letters that arrived. (They only sent 2 though so I missed it too).

He has found out today that his agreement has been terminated for failure to pay. Stupid idiot.

He had a default notice and should have paid by 23 April. But he didn't.

Is there anything we can do. He has had a call from the collections company to arrange collecting the car.

My credit score is perfect and I have no car finance. Is there any chance they will transfer the agreement over to me?

I am properly stressed out. He says he has phoned vw but they won't speak to him.

They won’t speak to him because they have past the debt into collectors. You need to open all post and find out who. Then ring and ask about a payment plan

Sorry OP, once the agreement has been terminated, that's it, unfortunately.

I'm assuming that, due to the amount he has paid, they can legally repossess the car.

It that's the case, he'd be best to phone them to arrange when they can collect it. The last thing you want is for them to simply pick it up from outside your house, when you're not aware.

I’d stall sending it back till you’ve inspected it for damage, if there’s any damage outside of what they permit you’ll get charged for that too.

My dh inspects cars at his place and people don’t check before handing them back then get pissy they’ll get charged for damage.

It depends, was the finance from the the car place or was it from a second party. Dh car finance is essentially a loan. (Idiot) He can’t give the fucker back!

Last year when we had money issues we defaulted and said they would send some one to collect it, they then would have sold the car at auction and we would have had to pay the short fall - which would have been about £17000 Shock

We borrowed and begged for the money to catch up.

@Cottonwoolmouth I think that's our situation. It's a valuable car so if it gets sold at auction we will be properly fucked I think. I think it's contract hire not pcp so I don't think we have the option to to buy even though we are nearly 3 years in to 4 year plan. We had no clue there was a difference....

Ridiculously this isn't because of financial issues. He's just been a stupid fucker who doesn't check his bank account and changed his mobile number and didn't tell them. They literally sent 2 letters (I opened all the post I could find earlier).

I'm desperate to find a way to speak to them to see if we can get this back on track. We have had a lot family issues going on (very ill child and mother) and I think he just dropped a ball. I'm livid with him but trying to not let rip!!

The other thing is that someone drove into the side of me. Insurance has all been agreed as not my fault but it hasn't t been to the garage to get fixed. So I really need to speak to someone to find out what we do about that too. It's a VW. He said he called a few times today but no one from the lease hire department would speak to him.

OP look at the paper work, who financed it? We bought from Mercedes but the finance/loan was through Blackhorse via Mercedes. Dh had to wrangle with them as they were adamant they were collecting the car the next day but he talked them round and got a few days to pay the money owed.

Yes, we have the arrears money. But not the whole loan amount (about 30k I think). I just can't get anyone to speak to me.
