Need bra help quick

Not sure if this is the right place to post but need some information.

On Monday I bought 2 new bras, turned out they didn’t fit great, brought them back and managed to swap one to a better fit. Also bought another nicer bra as first one was very grannyish looking.

Came home tried on all 3 and disaster. The newest one doesn’t fit right, tides up at the back, straps dig in and just feels uncomfortable.
Sports bra causes a lot of side boob so isn’t the right fit.
The original one which I got replaced I cannot fasten the bloody thing up. I’ve tried put it on behind my back, doing the clips up at the front and spinning but it is just so hard that I know I will never wear it as it’s a mission to put on. I actually asked my dc to help.

Went back yesterday were I was informed for the first time they don’t do refunds or exchanges on underwear. There is a small sign on the wall which I never seen and they never stated when I purchased there was no refunds/exchanges.Bras are in perfect condition, tags still on but they do not fit me.
Is there anything I can do about this? Does fit for purpose work here, I tried to say they aren’t fit for purpose because I cannot wear bras that I can’t do up and don’t fit but she said that only implies to faulty items.

I’m due to go back just after 1pm to see what they can do.

Between this I went else where and got fitted again and bought some lovely bras that fit, do up nicely and don’t cause any pain so I ideally don’t want them to refit, especially considering this would be the third time.

Have I any rights here?
I really want a refund as £120 is a lot of money to lose but would take a credit note if that is my only option. I just don’t want to be left with 3 bras I cannot wear.

Thanks for any help.

Surely the no exchange on underwear applies to pants/ knickers rather than bras. Which store is it?

dementedpixie · 03/05/2019 12:42

Did you not try them on at the time?

ThedementedPenguin · 03/05/2019 12:48

Its a local shop not a big store.

I did try it on, in the shop they felt okay but when I went to get dressed the next morning, I couldn't put the first one on at all regardless which way I tried.
The second one I put on okay, walked downstairs and back up and it was so uncomfortable, dug into my shoulders and was riding up my back. A bit like the one I am wearing today is doing (but its old).

So then I tried on the sports bra and I noticed the side boob going on under my shoulders, no way could I wear it to run/workout.

so 2 out of 3 are a bad fit and 1 I cannot wear as it is impossible for me to put on

Sounds like too big back size on one and too small a cup size in the others

ThedementedPenguin · 03/05/2019 12:52

I just want to know if there is anything I can say to get the place to refund/ credit note me for them.

Is this described as not fit for purpose, as I cannot wear them?

Its a very expensive lesson I've learnt, and worst case I will just have to try and sell them on and recoup some of the money.

According to the legislation;

"Not fit for purpose does not apply if clothing does not fit; you change your mind, or you've selected the wrong item for a particular use."

So I don't think that covers you here.

As you bought them in store, you are subject to their returns policy (unless you paid online and collected in store?) so your best bet might be to go and be very nice to them.

FiremanKing · 03/05/2019 13:57

If you had bought online and had delivered you could claim under distance selling regs but as you bought in store and tried them on, I can understand their reluctance.

Have you removed all of the tags?

AdobeWanKenobi · 03/05/2019 14:02

Current issues aside, have you been measured properly?

I sent years going to different places to be measured and happened to stumble into Victorias Secret when I was in the USA, they measured me and it was single handedly the comfiest bra I owned. Just bought a couple more in their sale and they are amazing.

dementedpixie · 03/05/2019 14:55

As you bought in store they don't have to refund you unless they are faulty. You'll just have to try and see what they say
