I’ve created this thread as I’m needing some advice.
Basically I advised my employer of my maternity leave roughly 2 months ago now, the week before my maternity leave was due to start my employer informed me that they wouldn’t be paying me SMP (I expected this as I don’t work enough hours for them to have to) with this being the case I obviously need to apply for SMA through the government instead but my employer is completely dragging his heels with it all, I’ve not been provided with the MAT B1 form I gave to them or the SMP1 form required for me to apply through the government.
My baby is due 04/06/2019 and it takes roughly a month for my application to go through which means I’m now off work with no income and a baby coming in a month, understandably it’s stressing me out a lot. I have asked my employer to process my unused holiday as a good will gesture but he is completely avoiding my request.
Is it unreasonable for me to be considering legal action against him? I feel all of this trouble could have been avoided if he had just followed procedure correctly and it isn’t the first time he’s not followed procedures. It shouldn’t be up to me to tell him what needs to be done, he should have already been aware of it and auctioned the process as soon as SMP refused by them surely?
Literally any help or advice on this is appreciated.
