Bullying sibling help!

Please help my middle ds is being assessed for asd at the moment he has a terrible temper but the worst part is he bullies his younger brother relentlessly. It's like him even being in the same room sets him off. He just doesn't seem to see him as a human and is constantly nasty to him. Obviously I tell him off and he loses things like his Xbox ect but it's just relentless. He's not like it with his older sibling just the younger one.

I snapped this evening after every time I turned my back he started on him saying if he breathes like that again he will kill him and I shouted at him for being so nasty. He then turns to his brother and says "you better get packing as I'm calling the police to tell them mum shouted at me which is child abuse and now we are going yo like in a children's home." Younger ds was beside himself and as much as I tried to calm him down older ds kept on saying it. It took me forever to get them to sleep as he just wouldn't let it drop. Plus they share a room which makes it difficult.

I just don't know how to deal with this we play games together but it always ends up being miserable as he starts on him. He says the most horrible things to him and I really don't know what to do. Has anyone managed to deal with this kind of behaviour and if so how?
