I recently contacted the CMS as suspected my ex was massively underpaying maintenance. They did an assessment and he due was due to me 96% more than he actually was. The new amount was due to be paid from 01/06. He continued to pay the usual amount. I contacted them in June to let them know, and July. They sent him another letter to give him another chance before issuing a DoE order. He still did not adjust the amount. Ex is military. They told me they started the process for the DoE, military claimed they hadn’t received the request twice.
I wrote to my MP who contacted the CMS and they said they had put the order on his wages as affect from 01/01/19.
Ex has now contacted the CMS saying he never received any letters and asking to go to direct pay and is willing to pay me twice per month of an adjusted amount to include an element of the arrears. However, due to the amount of the arrears his proposal means it will take him 9 years to clear them.
I’ve asked that my case worked phone me back as I think this is ridiculous.
This is the ex who is trying to gain sole custody of our child and move him 3 hours away.
So I’ve just spoken to my case worker who phoned whilst I was typing. She has said that even though the figures she received tutor the assessment were from HMRC he is disputing the amount and as he has a right to dispute he has 28 days to provide payslips showing what he believes is a correct figure.
This is so unbelievably frustrating. This is him just trying to financially abuse me from a distance whilst he tries to tear his son away from the only home and life he’s ever known.
