Adoption of UK children by EU citizens

Hi,
New on MumsNet so apologies if I’m posting in the wrong place or any other rule I might be breaking:-)
Does anyone know if EU citizens who live in London and are adopting a British child, can legally move back to their country of origin with the adopted child? Once it has settled in the family of course. They are in the process of adopting and not sure, what, with the Brexit circus, they should do. Carry on or pack it in and move back to Holland.
Asking for friends.

Can they get a passport for the Netherlands for their child?

ChristmasTwatteryDoesMyHeadIn · 29/12/2018 14:57

When I was adopted (many years ago) my nationality was decided by the nationality of my adoptive parents. I’m not sure if that has changed, so it might be worth seeking legal advice.

That'll be up to the Dutch immigration authorities, nothing to do with the U.K. I don't see why once adopted the child wouldn't then be entitled to a Dutch passport though.

They would need to contact the Dutch authorities to see what their nationality law is regarding adopted children.
British people adopting non British children register the children with the HO and that child then carries the same British c/ship as the parents.

If they can get the passport then there won't any doubt will there?

The Netherlands do not allow dual nationality.

Heuschrecke · 29/12/2018 15:25

There's an excellent Adoption topic on here www.mumsnet.com/Talk/adoptions where you might get some advice from those who have gone through an 'international' adoption process?

pointythings · 29/12/2018 15:29

Ammonite the Netherlands are working on allowing dual nationality for the victims of Brexit, and D66 are pushing for the Netherlands to abandon its rigid stand on dual nationality more widely. The tide is turning, we just have to hope it turns in time. Emergency legislation was discussed as recently as November.

I'm affected as a Dutch national - I won't take UK citizenship unless I know I get to keep my Dutch citizenship.

foxyfemke · 29/12/2018 15:32

I think this might be very complicated, so they would really have to check with the IND in The Netherlands.

Jazzhan · 29/12/2018 15:33

I would assume Brexit doesn't affect anything yet?

HarryG8 · 29/12/2018 15:39

Yes, you'll get more knowledgeable answers if you ask MN to move this to the adoption topic. (You can do that by reporting your post and they'll move it).

Thank you all! It was a bit of a stretch to see kf someone on here had been/is in a similar situation and it seems wisest to talk to the proper authorities to get an answer as per your advice.
