A driver recently smashed into my car and is now denying liability. It is 100% this guy’s fault, but it looks like my insurance company is going to settle it 50/50, as it is apparently a “he said/she said” situation without any witnesses.

So in addition to the inconvenience of getting my car fixed (irritating, but commonplace), his lies now mean that I also lose my full NCD.

I’m thinking that a lovely parcel of pretty glitter that shoots into the air when you open it would be a nice present for him. I have his address, he doesn’t have mine.

Or perhaps I spend the money on a lovely bottle of wine for myself and just hope that karma kicks him in the ass instead?

You absolutely do NOT need to accept a 50/50 deal. I had this 15 months ago. Driver admitted liability at the scene. No witnesses (motorway, no one stopped) then when all insurance got involved, they denied it was their fault. I flatly refused to budge as it 100% was not my fault. After a year, they offered a 50/50 deal. I refused. 15 months later we got a court date. 4 weeks before going to court, the other person caved and the insurance agreed to settle.

If it is not your fault, tell your insurers that you will NOT accept 50/50. You pay them a premium to do a job, and they are taking the easy route out.

I argued a 50/50 claim 100% knowing it was not my fault. There was no damage to my car and yet they were claiming the back of their car was badly damaged ( they reversed into my car ). As far as I'm aware it never went anywhere.

My mum argued a 50/50 claim all the way to a hearing and won. Massive pain in the arse for her but she refused to give in.
