I bought a costume for £1.50 off eBay for ds and have just received it, as I've opened it I noticed the mask has a crack at the bottom, so what would you do open a case stating it's not as described or suck it as it was only pennies?
If it makes a difference it's an Xmas present so i wouldn't have bought it if I'd have known it was broken and all the others are selling for £££

Did it say anywhere that it was damaged? If not, I would personally open a case. So what if it was "only" £1.50. They could sell 10 damaged ones and make £11.50 and if no-one raises an issue, they could carry on.

I know it sounds a bit tight fisted but it annoys me something rotten when things are not as advertised.

Nope, I've just looked back at the listing obviously it says it's in used condition, but nowhere does it state that it's damaged.
