Can an employee secretly record a conversation between 2 other employees in the office when they’re not there?

I’ve searched on line but can’t find a definitive answer. Many thanks.

I think it depends what they plan to do with the recording.
Move this post to the Legal board and I am sure you will get the answer.

No as the person recording doesn’t have consent from those being recorded.

It's not illegal as long as it's for your own use. You need consent once you plan to make the recording available, I think.

Thanks everyone. I’ve posted in legal matters too and it does seem to be a grey area but the general consensus is that if it’s not illegal it’s most definitely breaking confidentiality/HR codes of practice.

I know this because I've just dealt with it happening. You can record someone without their knowledge, that isn't illegal. However as soon as you share the recording, or a transcript of the recording, with a third party you are breaking the law and open to being sued. In the workplace it will be different because you will be likely to be breaking a code of conduct or similar, in which case expect a disciplinary, maybe the sack.
