I am divorced. My ex wife and children live at the FMH. I pay the mortgage. The house is under court order to be sold and should complete in November. Since leaving the FMH my ex wife has refused to engage with me on any level hence our divorce became very protracted and was litigated via lawyers. My ex wife refused to agree the division of the marital chatells and the judge ordered that they be split by lots if we could not agree of their division. Given the fact she will not engage with me unless I open up a line of expensive communication using a lawyer, there is no agreement reached on the division of the marital chatells. I have written to her to attempt to resolve the issue. This has been done by lawyers and me personally since I disengaged my lawyers and she has ignored all requests to resolve this matter. She did in fact try to blackmail me when signing the fixtures and fittings document for the sale of the house stating she would not progress the sale unless the chatells were addressed in the fixtures and fittings document! She was advised she would be in breach of the court order to inflict such conditions as the two issues were not linked. At this point she was happy to cost me money as I had lawyers involved just to get her to agree to the sale of the house after it being on the market for a year!
We were together for 30 years and I left the FMH with just my clothes. There is a lifetimes belongings in the FMH. I am not under any order forbidding me from entering the house but she has changed the locks. She is a little dramatic and has in the past called the Police on me when I have gone to the house to collect the children so as she is trigger happy on that front I cannot just turn up and insist on being let in as I am co-owner.
I need to know from someone who has experienced the same scenario as me how they overcame this problem without having to engage lawyers. What do I need to apply for to gain entry?
I cannot afford to litigate this with lawyers. That is the one thing she is waiting for as she loves to cost me money. She is surrounded by lawyers friends who goad her on to ruin me and thus far they have cost me £100000! I cannot afford lawyers and need advice from someone who knows the law on this front.
