Im due to go back to work in sept from maternity leave. However due to fall outs with management and involving HR i dont want go back. Can i just give my 1 month notice whilst in maternity leave?

Yes you can but I would wait until one month before your leave is due to end so that you accrue all of your annual leave and bank holiday entitlement as well.

So i can 'work' my months notice whilst on maternity leave?

Sorry for the slow reply! Absolutely yes you can. Just because you are not present in work, your employment doesn't stop.

You may need to be careful about any additional maternity pay you received which could be repayable? I mean pay received above and beyond statutory, employers usually protect themselves by having some kind of return clause. Only if they pay over and above SMP.
