Someone help me feel less guilty and tell me what to do.

Split from EX who refused me any belongings. After 13 yrs together I got jack all. Nothing. Zilch.

Resulted in me taking him to the small claims with ANY receipt I could find, total value a ridiculous 800 quid, "take me to court, itll be a laugh" he said.
He didnt turn up in court even though he defended it.
Then the baillifs were instructed and he defended it again. Didnt turn up again.
Then the baillifs took his car, worth about 7 grand.
So now hes been told they are gonna sell it in the next 7 days, he literally begging me to work out a payment plan. Ive told him to take it up with the baillifs. He now owes 3 grand.

Ive had a letter from the baillifs, he wants to enter into a pyament plan, 100 quid a week. OK, but I only get a percentage of that weekly as the baillifs also take their cut for fees, I want my return quickly.

hes been an absolute shit with me, refusing me my things, he took the car off me and cleared the bank account so I had to literally walk the 4 miles to work, in the snow. Generally made life hell for me, dogged me on FB about how the baillifs are looking for me, laughed about only having to pay me 5 a week if he lost the case, also recently actioned a small claim against me for sunglasses and half HIS mobile phone bill!

I could go on but wont bore you.

Do you think hes had enough karma?

Would you instruct to sell the car and get your full return or accept the payment plan at a pathetic amount a week.

I'd tell them to sell the car. He's an idiot! All cocky and now it's come back to bite him he's all woe is me. Get the car sold, take your money and forget about him.

KillmeNow · 28/08/2014 13:10

Is the £100 per week just to clear the £800 you receipted for? If so how much do you get in the end?

Its tempting to let them sell the car but realistically how much would you get out of it after bailiff fees etc?

If you just want to hurt him as much as possible without benefiting much yourself then sell the car. But if you need the money do your homework and find out what you will be left with at the end of all this. Seized cars that are auctioned off can often go for much much less than they are worth.

But then again ,I would sell the car anyway -sod him. Grin

Sell the car, sell the car, sell the car Grin

losthermind · 28/08/2014 13:19

Definitely sell the car, what's to say he won't default on the weekly agreement??? Serves him right he sounds like a complete bell end

grumpychops1 · 28/08/2014 13:50

He pays the fees, so if he had just paid originally before the baillifs Id have got 800.
He now owes 3000 grand, 800 of mine and the rest baillif fees. It will be paid to me pro rata, so from the 100 quid a week, we'll get a bit each, thats the way I understand it anyway.

I'll prob have to pay about 100 quid for my fee.

He will have to pay the bailiff fees and this is his just desserts. Tell bailiff to get a valuation and sell up. They can give you a valuation ahead of the sale (work with bailiffs or enforcement agents as they like to be known as on a daily basis).

bloodyteenagers · 31/08/2014 02:28

Tell him tough shit.
Sell the car.
He had how many chances and now he realises oops you mean business he wants to make a deal.. Too little too late.

Back down now, and he will come back again and again because he knows he will be able to tell you some sob story and you will run..Again and again.

grumpychops1 · 31/08/2014 10:26

You're absolutely right. I was in my backside for months whilst he swanned about having holidays etc, gave me nothing.
I'm selling! Smile
