Following public objections, the CPS announced yesterday they have changed the proposed legal guidance on Rape and Serious Sexual Offences (RASSO), specifically the guidance on “Deception as to gender”, which can be found in Chapter 6 Consent, to 'Deception as to sex'. Rape and Sexual Offences - Chapter 6: Consent | The Crown Prosecution Service.

The outcome of the consultation is available here: Consultation on the Deception as to Gender section in the Rape and Serious Sexual Offences (RASSO) legal guidance | The Crown Prosecution Service.

summary of consultation responses here: Consultation on CPS guidance on Deception as to Gender - Summary of Responses | The Crown Prosecution Service.

There are ongoing problems re ideological capture by trans lobbyists and misogyny within the CPS so thanks to all who contributed to the changes they have reluctantly introduced.

Well dead cos we can't do brain transplants so it's a pointless question

Yes. Transplanting a brain coded for a male person into a female person or vice versa means the control centre for the body is likely to not be able to keep the body healthy and maybe not even alive. How will it regulate a body of the opposite sex?

So if, say, due to some kind of exotic terrible injury your brain had needed to be moved into a body that was phenotypically male at birth with male genitalia and able to undergo endogenous male puberty, you would have grown up to be...what?

ArabellaScott · 18/12/2024 18:50

What if, like, we could bring people back from the dead? Eh? Eh?! WHAT THEN???!!!

Helleofabore · 18/12/2024 18:47

If any person has a brain transplant with a brain from a different sexed body then they have a brain that came from a different sexed body that had the coding for that sexed body where it was formed.

What is the point of the discussion?

I'll decide when it happens 🤷‍♀️

Brain transplants now is it? In addition to double mastectomies, hysterectomies, castration and the rest of the Mengele inspired surgeries we're adding brain transplants.

No end to it is there? 😂

I'm afraid it's my fault, because of the brain in a jar thing. But I'm willing to answer @ButterflyHatched 's question. In that situation, I would live as a man, because I would have the body of a man. And human beings can't change sex. My feminine brain (?) would have to lump it.

It is an irrelevant exercise, no brains are transplanted.

So the answer is?

No male person can experience life as a ‘woman’. There is no way for them to do this, regardless of any changes they make to their bodies.

And their brain is always that of a male person. It retains a shape and size that is not female. And any pathways laid are going to be the same for any male with specific interests and taking a specific drug treatment.

It doesn’t matter how much a person wishes their male brain becomes ‘female’ or adapts to be somehow a ‘woman’s’ brain , it simply will never be.

BaronessEllarawrosaurus · 18/12/2024 17:15

Yes a certain person is not and never will be a woman because it's a biological impossibility. All anyone born male can ever be is a facsimile. They can never live the reality of womanhood. They can never understand the fears that being a woman entails, the struggles, the issues.

No, I don't think it's inherently transphobic to say there's an embodied component of womanhood.

That's certainly how I understand it, but I wouldn't stop being a woman if my neurological tissue was isolated from the rest of my body and migrated to a synaptic scaffold inside a life support system - and I don't think any other woman would either.

The pattern of information that makes up the person I grew into is one that self-classifies as 'woman'.

I can falsify your statement: I feel quite strongly that if my brain were put into a man's body, then I would be a man. I wouldn't be wild about it, and my personality would be quite quirky, having been shaped by X chromosomes, œstrogen, and a lifetime's socialisation, but I would rather live as a man than compromise my health.

I was curious about how others felt, so started a 'brain in a jar' thread on AIBU, and it turns out that 70% disagree with me, so your instinct was correct.

ApocalipstickNow · 18/12/2024 15:52

What a wonderful world we might be living in had anyone bothered putting the energy into ending male violence- whoever it’s directed at and however they present or identify- rather than causing as much aggro as possible for any women who disagree trans women are women.

What a fucking waste of time.

Iguanothankyoudon · 18/12/2024 13:46

Ereshkigalangcleg · 18/12/2024 13:27

So, no examples of a trans panic defence at all. How very surprising, you normally pepper these threads with links to evidence.

Grin very understated

TWETMIRF · 18/12/2024 13:20

I would like to know what those patterns are and how they compare to women.

MarieDeGournay · 18/12/2024 12:35

ButterflyHatched The pattern of information that makes up the person I grew into is one that self-classifies as 'woman'.

whereas the rest of us just have to make do with objective observable biological reality.

I mean, this reply is just mumbo-jumbo.

But thanks for trying anyway @popeydokey

I've yet to see any real transphobia anywhere in the UK. What I have seen is a nasty bunch of TRA/MRA types throwing around the accusation of transphobia whenever anyone (particularly women) refuse to bow down to the insane demands of the "trans movement" over language, sports, spaces and our bodies. Now we have you claiming that it's transphobic to hold trans people to the same legal standards as everyone else when it comes to obtaining sexual consent oh and that only a transphobic, homophobic bigot for not wanting to have sex with someone who isn't the sex that they represent themselves as.
Also transphobia can't be homophobic or misogynistic as the whole notion of gender ideology is the epitome of homophobia and misogyny on steriods

Well at least you've made your lack of awareness of our daily lived reality clear.

Hoardasurass · 18/12/2024 10:57

ButterflyHatched · 18/12/2024 10:42

Transphobia is, broadly, throwing homophobia and misogyny in a blender to make a particularly virulent bigotry smoothie and up until the mid 00's or so most people didn't even make a distinction. Unsurprisingly I was paying quite close attention - I didn't have the luxury of ignorance.
