If a patient requests same sex care and a doctor lies to them and performs intimate care, that should be a sex crime

as a general principle everyone should be offered same sex doctors and nurses and carers for intimate care and anyone who lies or omits the truth about their real sex should be prosecuted.

do you agree?

Triggered by the recent court case

”Upton also told the court that he would not proactively disclose his transgender status to a patient. He considers it a ‘private matter’ akin to ‘my medical history, my sexual orientation, my place of residence, my age’. If a patient were to request to see a female doctor, he said he would have no qualms ignoring their wishes, as he considers himself a woman. It would be up to the patient, he said, to make a request for a different doctor. That a sick and vulnerable person might not feel able to stand up to him didn’t seem to register as important.”

Calling yourself a woman does not make you ‘biologically female’

An NHS doctor really believes he can identify his way into the women’s changing rooms.

Is there enough doctors as it is for people to be able to be seen at all let alone picking or choosing by whom?

Devilsmommy · 14/02/2025 08:05

It's amazing to me that we've got to the point that this is an issue. It's definitely sexual assault in my eyes. His attitude says it all really doesn't it. 😡

The deception is the point here, not NHS funding. It might be a private care home, or BUPA, or anywhere. The key thing is the omission of a key fact, the deception.

Yes it absolutely should. It’s disgusting and I’m fed up of having to entertain this nonsense.

NebulousDogwhistle · 14/02/2025 08:08

Clearly it would not be informed consent, if a male HCP examines a patient that has only consented to examination or care from a female.

Wearing makeup or earrings and changing in the female changing room does not change your DNA, nor will cosmetic surgery and cross sex hormones. And nothing it would appear will remove male entitlement and impose female socialisation.

Sandie Peggie is in the right.

Naunet · 14/02/2025 08:11

It absolutely is sexual assault as no consent has been given. He doesn't even need to reveal his trans status to anyone (as if anyone couldn't tell anyway), he just needs to respect what a female patient has asked for and not involve himself.

It blows my mind that organisational guidance gives more weight to gender and not sex. Absolutely blows my mind that we live with fiction and that it impacts reality. I hate having male doctors for intimate procedures, following a couple of awful experiences. I don't want to have to navigate accusations of bigotry when thinking about who I'm comfortable with inserting objects into my vagina.

Doyathinkhesaurus · 14/02/2025 08:19

I stand with Sandie Peggie

Intimate care should be based on sex not GI. Breaking that trust should be an offence.

lifeturnsonadime · 14/02/2025 08:20

Yes it should be sexual assault.

To me it's similar to sex by deception which is already a criminal offence.

Any man who conceals his sex and claims to BE female and knows that the woman only consents to being treated by a female is using deception.

Arseynal · 14/02/2025 08:21

There is a world of difference between “I’m sorry, there isn’t a female doctor on duty right now, would you like to see the male doctor with a female chaperone?” or “I can make you an appointment with a female doctor but the next available one isn’t until July” and telling a patient they can see a female doctor and sending in a man. Especially when the man is challenged and says “I am a biological female” when they aren’t. Consent still matters, even when the service is stretched and consent obtained by deception is not consent at all.

5128gap · 14/02/2025 08:26

I struggle to see that there could be any legitimate reason to trick someone into allowing you to perform their intimate care against their stated wish, whether you personally agree with their wishes or not. So yes, anyone who does this should be subject to investigation.

I think the presumption should be same-sex, but that’s not always possible. To examine someone intimately without revealing one’s sex should indeed be a crime.

See the case of Dr Kamaruddin who transitioned from male to female as a GP in 2015 while working in east London. They now work at a gender services clinic.
They wrote about their transition in the British Journal of General Practice in an article headlined 'What it's like to be a transgender patient and a GP'. They said: 'A lot of my patients were quite conservative — many female patients wore long clothes, or the hijab — but they allowed me to examine them despite my change.
'Every single one of them refused my offer of a chaperone even when they knew that I am transgender.'
They were given a prize at the Royal College of General Practitioners 'inspire' awards in 2019.
The GP wrote elsewhere: 'I had a fear that my patients would treat me differently as they might not agree with my new identity due to prejudice and ignorance.'

There might not be, but it's for the patient to decide whether the lack of someone of the sex they've requested is something they can deal with, or whether they refuse treatment.

There is already guidance in place to deal with emergency situations and when patients cannot give consent, but when there is time, and they can give consent they need to do so with accurate information given.

Concealing your sex by lying, or even just omission, invalidates informed consent if your patient has asked for care to be provided by a person of the opposite sex to you.

HermioneWeasley · 14/02/2025 08:27

Absolutely. Women’s bodies are not validation tools for males with gender dysphoria.

Similar to the police services still allowing trans-identifying men to search female prisoners.

username299 · 14/02/2025 08:28

It's very strange how many members of society are kow towing to men with delusions. Not so long ago, a Dr who had no idea about biological reality, would have been sacked for incompetence.

How can he do his job if he doesn't understand biological difference?

This 100000%
I was a GP for 32 years. It makes my skin crawl reading this and personally I have no issues being examined by a man (as I've got older I appreciate the chaperone) I had a male sonographist do an internal gynae scan on me once he was excellent.

I have been in situations where there were no female medics. It still boils down to consent. The nursing staff told me of the situation and I had chance to prepare. I could still have said no. Then it would mean working out the next steps, but I could have said no.

It all boils down to consent

TickingAlongNicely · 14/02/2025 08:29

A doctor should put their patients first at all times.

Jellycatspyjamas · 14/02/2025 08:30

Totally agree, it’s a nonsense we’re even having this discussion - I should have choice over the medical staff examining me and a man doing so in full knowledge that I had asked for a female clinician is wrong regardless of their gender identity. I’m not interested in pandering to men’s hurty feelings.

Exactly this.

If there isn't a female then there isn't a female, but we can still be honest about that.

Are you suggesting that women don't have a right to object to deception in accessing their right to same sex medical care?
