School made malicious & false report to police

I have previously posted on here about my DD’s school constantly harassing us about attendance..
For example, my DD was in hospital, they called me every single morning asking where she was?and when she would be back in school. She had chickenpox, they wanted me to send her into school despite the governments rules about keeping her off. The list goes on...

My DD, age 5, was recently diagnosed with hearing loss and has naturally, really been struggling in school. She is waiting for hearing aids to be fitted.

She obviously struggles to hear the teacher in class. Other background noises, such as loud noises from the other children, upset her.
She can’t cope with a full day at school it is completely exhausting and draining her that whenever I pick her up, she has huge meltdowns, screaming crying and really upset 😔

In the mornings she is that anxious and worried about going to school that she is physically sick and vomits.

One morning, she didn’t want to go to school and was clinging onto my leg, the teacher came and physically dragged her off me, picked her up and took her into the classroom. She was screaming “mummy mummy” as she was dragging her away. It was awful.

I have spoken to the headteacher and the SENCO. They have not been supportive either.

They sent me a message saying that a plan needs to be put in place in order for her to return to school..Then the next day sent me a message asking where she was and why she was not at school

  • As if they were completely oblivious to everything, despite having multiple conversations with the SENCO, headteacher, attendance officer.
They knew why she wasn’t at school but pretended not to? It’s crazy

Yesterday, 2 police officers came to our house and said the school had called 999 as an emergency and said that they have had no contact with us and that they are extremely worried for the safety of my child.

However, I had messaged the school in the morning giving an update.

I immediately showed the messages to the police officer, who checked the time of the report and told me that they had definitely reported us AFTER I sent that update.

They called 999 at half past 3, after school had finished. I messaged in the morning, they even replied to me and said “thank you for the information”

So the school has been caught out with their lies.

The police officer said in her professional opinion, someone at the school has a personal vendetta against us and has maliciously reported us to the police.

The police officer said she will record this as being a malicious and fraudulent complaint.

She said that whoever reported us from the school was very aware and it was definitely orchestrated as she said they deliberately used all the “trigger words” that would mean such a response from the police.
So they knew what they were doing, it wasn’t a normal or genuine concern.

The police offers were actually shocked by the behaviour of the school. I explained everything the school has done and they said it is definitely harassment.

Does anyone know if it’s possible to take any legal action against the school for this harassment/false report to police etc ?

Your relationship with school has severely broken down, your first move should be to look at other local schools as this is really very early to be having issues with them and probably won't improve.

Make the new school aware of your DDs issues from the outset so you can get their support and buy in.

Then maybe do a FOI on communication related to your DD. Go through the governors for any complaints but I'd just move school.

FannyFernackerpants · 13/12/2024 12:50

If thus genuinely happened why are you not in the process of moving schools?
If a teacher dragged my children into school while they were crying for me I definitely wouldn't have them enrolled there much longer.
Do you think things will improve if you start legal action while your daughter is still attending that school?

Choconuttolata · 13/12/2024 12:51

I would speak to the Educational Welfare Officer at the local authority to discuss your daughters situation. We did this once when DS who has ASD had a lot of absence and we kept getting threatening letters despite school being fully aware why he was not in (when unwell they couldn't manage his behaviour and often sent him home on reduced timetable). They were really helpful. Your daughter may also be entitled to an EHCP due to her hearing loss or at very least an IHP, speak to your local Sendiass to get advice on this. She has a disability and school need to be making reasonable adjustments. You can also speak to your GP to get a letter of support or her paediatrician and audiologist.

JustWalkingTheDogs · 13/12/2024 12:51

I'd be looking at moving schools or even home schooling for a period of time

Not a FOI for personal data , a DSAR.

Anotherworrier · 13/12/2024 12:56

The police officer said in her professional opinion, someone at the school has a personal vendetta against us and has maliciously reported us to the police.

How wildly inappropriate - her job is to gather evidence, not attain a verdict.

The school will obviously have their own version of events and I think they are highly unlikely to do this just to be nasty, they are more likely to be genuinely concerned for what ever reason.

It really does sound like a struggle though, if you and school cannot work effectively together your DD needs to go somewhere that you can.

hydriotaphia · 13/12/2024 12:57

Given recent news reports, I think we all understand why schools have to be vigilant about attendance particularly with children with unexplained physical symptoms whose parents are less than good at communicating.

Regarding calling every morning when your child was off - this is normal I think, you are supposed to call the school every morning while a child is absent.

They are obviously correct that a plan needs to be in place for her return to school - she has a right to education and there is a legal obligation for her to be in education.

Calling 999 - someone is obviously very worried about your daughter.

I suggest you book a meeting with the head and talk about your daughter's needs with the school.

McGregor33 · 13/12/2024 12:58

I recall a teacher pointing her walkie talkie in my face and shouting at me to move as I dared go to comfort my daughter who was crying in the line. I quite sternly told said teacher if my child was crying and being ignored I’d be stepping into comfort her.

She’d fallen and was still upset etc. Once she’d calmed down I left the line.

I reported it to the headteacher who was pretty dire, a lot went on at that school though. From my child being wrongfully given flu sprays when consent hadn’t been given. I also had them call the police on me for a welfare check as I’d left the school with my child following an unexpected thrown together meeting with me and ex husband… who had bail conditions not to be near me or child.

I removed my daughter and contacted head of education. This got it sorted and following a change of head teacher my daughter thrived until she left for high school.

Definitely get the head of education involved and send a letter/email advising that you are happy for work to be completed at home until a meeting has been had to ensure your child’s needs are being met.

Fluffyunicorn1 · 13/12/2024 12:58

Move schools. Despite the police report they are not meeting your child’s needs.

nobody would be dragging my dd anywhere! That would have been nipped in the bud there and then in front of everyone if needs be.

my eldest dd is in year 9. Last year they had an awful male teacher working there and on one occasion he shouted in my dds face. It was all over her pen running out and she didn’t have a back up pen. The school tried to tell me it didn’t happen so I made them look at cctv whilst I was there and made it clear that if they didn’t I would be taking it a lot further. Lo and behold she was telling the truth. This teacher was about an inch away from her face, screaming at her telling her she was useless. Well he didn’t work there for long after.

she’s looking at you for protection. She’s clearly not happy there so remove her and start looking for a new school that will better suit her needs

Katemax82 · 13/12/2024 12:58

They sound shit..my son has terrible school attendance problems/reduced timetable and I've experienced none of this harassment

RegulatorsMountUp · 13/12/2024 12:59

Sounds like you're at home and I assume not working anyway, I would just de register from school and home school until she's in a better place with hearing etc then look for a new school in the new year. Take all the stress off you both.

FumingTRex · 13/12/2024 13:00

I would move schools and report to the police for harassment.

Janedoe82 · 13/12/2024 13:02

What is your child's attendance? I suspect a lot more going on here than you are disclosing.

I can't believe the police officer would say in her professional opinion someone has a vendetta. How the fuck would she know? And saying they used 'trigger words'. Well, it's a school isn't it? Either she's very unprofessional or she didn't say any of those things.

Gettingbysomehow · 13/12/2024 13:04

Bloody hell, who are these people and why the hell are they allowed to look after children. Adult bullies.
I'd definitely look at changing schools ASAP with home schooling in the interim. That is if you are at home during the day.
Shame nobody was this over zealous with poor dead Sarah.

MiraculousLadybug · 13/12/2024 13:04

Schools can't win. When you don't send your child to school and they don't routinely know why (as you said in your last thread you don't follow the absence policy and you don't ring them every morning of the absence) and they go out of their way to ask, and one time they follow it up with appropriate services when they don't know where your children are on a regular basis, people say it's harassment.

When they don't follow it up properly, and something awful happens like Sara Sharif, everyone says it's the school's fault. I think the school's only issue is they followed it up the one time you actually told them where your child was and that message never reached the DSL from admin.

Her name was Sara.

Regardless of what has gone on, relationships have broken down to what would appear to be no return. At this point I would just switch schools. Visit some (I'm guessing in January now) and talk to the heads and senco etc to get a feel of what might work for/with you.

It's a fact that not all schools work for all people, even the "exceeding" ones fail individuals who do not match their ethos.

Personally, I'd be looking forward, and not back. Legal action of any sort would be long, drawn out etc and be another demand on your time, when it sounds like you have enough on your plate

hydriotaphia · 13/12/2024 13:05

Yes, if a police officer said that then it was incredibly unprofessional. I think it's vanishingly unlikely anyone has a 'vendetta' against you. The school is trying to get your daughter to attend, because that's their job (and because it's well established that it's best for the child to do so). Possibly the school's attendance officer is a bit crap /heavy handed, but there's a huge difference between that and a vendetta. Drop the persecution complex and try to work with the school.

HPandthelastwish · 13/12/2024 13:07

@LIZS thank you I couldn't remember which one off the top of my head and hedged my bets.

MiraculousLadybug · 13/12/2024 13:08

This all sounds very chaotic in general OP and I think you would benefit from some support from Social Services, if they have space to offer it.

Awful for you all.

Look for the not fine in school Facebook group

In relation to the hearing loss, would be worth finding your local groups and look into learning BSL

If you want any signposting let me know

Prescottdanni123 · 13/12/2024 13:10

I would be pulling her out and homeschooling her, at least until I could find her a place at a different school. And definitely take legal action against the school. There is also a case of wasting police time to answer for here.
