AIBU?

To think it’s just so unfair? *MNHQ trigger warning*

I’m basically on suspension from work whilst there’s an investigation as I was raped by a colleague and informed the managers.

But I’m on a zero hour contract with no time line of how long this will last, whether we’ll both be let go, or anything. I’m not working so I can’t get paid and I’m so frustrated that I can’t do my job and earn money like I’m the one in the wrong.

I’m sorry everyone I just needed to rant

Have you contacted ACAS or your union? Sorry this is happening to you.

Massively unfair but I do hope the person who raped you has also been suspended.

Are you the OP from the other day? The guy did get suspended then?

You should contact the dwp and see if you're entitled to jsa.

Yes I’ve been posting about it. We both got suspended while the investigations happening but I’ve heard talk neither of us will be allowed back

OP isn't seeking jobs though Confused

Contact acas, your union, the HR department. It seems odd that you are being suspended without pay. If it is a measure taken for your benefit then it clearly isn't working. I would have thought your employer has a duty of care to support you in some way.

You shouldn’t be suspended without pay in that circumstance. Definitely contact ACAS.

Sorry this happened to you Flowers

Why have you been suspended??

Awful.

I’m not allowed back while they’re doing the investigation and suspended is the word they’re using

Bloody hell Sad get some legal advice.

Report

To start with get to your doctors and get signed off. Dodgy grounds with a zero hour contact but you might qualify for SSP. Either way you'll need support now to try and prevent long term issues over this.
I'm very sorry you're going through this though Flowers
Secondly go to the citizens advice. They'll have someone there that can advise you the best way to get through this financially.
Do you have the suspension in writing? Or is everything verbal?

Report
Pengggwn · 23/04/2018 15:16

By what justification have they suspended you? What did they actually say?

Report
Bluntness100 · 23/04/2018 15:22

I think it's fairly standard for both parties to be not allowed to work in case of a false accusation or an actual rape, until the investigation is completed and they know either way.

Op, are you the same lady who said he had been fired? Was that not correct? Is this with the police? Who is conducting the investigation?

OP I read (I think) your other thread and I think you need to seek legal advice. I’m sorry this is happening to you.

@LovelySouffle why the Hmm face?

Oh my God, this is awful. I am so, so sorry you have been put in this position. You shouldn't have financial stress on top of what you have been through. Please contact a charity that can help - Rape Crisis or Citizens' Advice may be able to help. I am no expert, so I could be totally wrong, but I suspect the issue may be the lack of a police report/full investigation of the rape. I'm so sorry.

I don’t mean to sound unsupportive. I was on your first thread and I do really feel for you. However, it would have been so much easier had you reported this to the police.
