What are an employers responsibilities?

I have taken on 3 assistants (I'm a childminder btw)

They do not work school holidays (they want to stay at home with their own children)

They work up to 6 (ish) hours a week

Do I have any responsibilities with regard to Holiday/Sick and Maternity Pay.

I pay half if they are sick - but nothing if their child is sick (I normally encourage their children to come with them - so they have no childcare costs) and the earn free childcare from me (1 hr per week worked)

Have I got myself into a sticky situation

(wow heavy for a saturday night)

Mindee has whole of sitting room and hallway to play in so has loads of space.

Xena - you do know that an assistant can't be in sole charge of any children (without written permission and then only for up to 2hrs)

Also when you are on mat leave if your assistant was a registered minder she would only be able to have the lower no. of children (3

I was hoping to get them registered in their own right but on my premises and hopefully as I would be responsible for my own children we could keep the service for the rest?

Be careful - it's children on the property,

If I'm working by myself I can only have 5 children under 8 as dd counts - even if she is being looked after by DH (and vice versa)

So they may include your children??

Its v confusing. Might have to work it that I don't claim SMP (102 per week) and still be working but assistant do most of work and me just an extra pair of hands?

I know it is a really silly question but how do you fit them all in a car?

We are a couple of minutes walk from the school and about 10mins to the park and the shops. At the moment 3 out of 4 are teachers children so holidays are not an issue as I can fit my 3 and 1 mindee in the car. If we have a 4th I will buy a Toyota Previa (8seats). During the day I only have 2 of mine and 1 mindee so again we all fit in the car.

I'm hoping they wouldn't as I would be here, but don't need to be greedy and can still take pay from CM buisness. Am sure I have more than enough space I want to knock down my conservatory so we have a bigger Garden and I think that we will still have enough space. Thanks for your help goodnight Am going to be really be disciplined and turn the computer off now

Sorry KMc not been so much help to you but I think that if you call those people on the link they will be able to send you a condensed book on employer responsibilites. There used to be diffrent rules for buisnessess that employ less than 4people but alot of that has changed (making it harder for small buisness's) you are right though just the holiday pay seems to add alot of money to the assistants wages. Let me know of what your specific questions are I can ask DH as he is trained in employment law.

p.s. I assume that you produce a pay slip?

Yes I produce a manual payslip and use the PAYE tables on the IR CDRom.

But I may have to lay them all off and reduce all outside activities (ie DH's Tennis, my reflexology etc) as we just can't afford nearly £6 an hour
