Resignation or sick leave?

Dear all,

I hope someone can advise.
I am considering resigning from my job. It is making me very ill with stress, and causing me to not sleep and making me feel generally awful. My manager is bullying me, and I have had enough.

My question is, do I resign and then go off sick, or go off sick and then resign?

what is best?

Agreed, go off with work related stress, submit your grievance and then look.

Do you think some time off and a resolution to your grievance would help you to stay?

My manager is toxic. I cannot speak to her.
I do have another job to go to.
my worry is about having sickness on my record. She is my reference too.

How soon before your new job asks for references? If not long hang on for references, then go off sick.

She has already done the reference as I was meant to go a while ago but I stayed to help the team.

If you’ve got a job to go to get out. Maybe even have a conversation and say to avoid putting in a grievance let you go on very short notice. If I was HR/Senior Management I’d choose to miss someones notice over dealing with a grievance.

The problem is there is no one to talk to but her. Her manager is her best friend and it’s just all so stressful. I’m never sick, and certainly never gone off with stress. I don’t know whether to resign tomorrow and then next week to sick, or just go sick but then I’d still have to resign to start the new job wouldn’t I!?

Have you had an unconditional job offer? If so, the sooner you resign the sooner you can leave. So do that, then go off sick if you can’t stomach working your notice

If you’ve got a job to go to then I don’t really understand this - go to the new job. Surely they want a start date from you anyway?

I said I would have to do my notice
three months - but I was weighing it up as the pay is significantly lower. Now I feel my mental health and sanity is worth more than money, so I am wanting to go.
My worry is not resigning but having to work the next two months with this company in this state. I’ve never even considered going off sick in my life, but now I’m seriously thinking about it.
so I just want to know what to do first - resign then sick, or sick then resign?

I don’t understand, if you have a new job why have you not resigned!

I would say, sick leave first with dr note then resign, your sickness should cover your notice period as long as the dr gives you a sickness note for the time required or agree yo extend it.

Have you agreed a start date with your new job? You say you have 3 months notice with your current job, but there’s a possibility they may just let you go immediately if they think you’ll just go off on sick leave until your leaving date. If you have a job lined up I’d say you need to hand in your notice first. Then, depending on how long your current job want you to stay on, decide if you can cope with that or if you need to go off on sick with work related stress.

I’ve been there, and it’s a situation that just consumes your while life, so you have my sympathies. I looked for other jobs and raised a grievance at the same time. I was about to accept another job and hand in my notice, which was the catalyst for HR to actually take notice of how bad the situation was as they didn’t want to lose me. So they started a proper investigation which led to my bully handing in her notice as she knew she would never win, and I ended up staying. It was an awful time and I wouldn’t wish it on anybody.

I was in a similar position - was signed off sick with stress and was promptly fired with immediate effect the day after! Currently seeking legal advice....

It makes me so sad all this.
there have been numerous people either go off with mental health illness (one even attempted suicide) or leave because of her. I even went to our big boss and said the words bullying and she’s actually been promoted. It’s an absolute joke. She victimises me, bullies me, puts all the work on me, picks apart everything I do, and I’m so so sick of it now. Today was the last straw. I was actually wanting to stay due to the money, but it’s not worth this awful stress.

@Babybelle81-- she sounds like a hideous cow. Makes me angry that people can be such c*nts in the work place.
Get out of there asap! Hand in your notice and immediately spk to GP snd get a sick note.
Do it - your mental/physical health is precious.

Honestly? Sometimes you just need to go. For the sake of your health. Resign. Go off sick. Get a bit of headspace before you start your new job. I have a similarly horrible manager and will be doing almost exactly this.
