Has anyone got a new job after getting a disciplinary from the previous job?

Sorry for the long title,
I need some help, had a really crap end of year, got made redundant from a job I love.
started working a new job shortly after.
I’m facing disciplinary action after I done something wrong, I totally deserve it and it’s my own fault, however I have come to realise the job isn’t for me,
ive been told it’s procedure and my job is not at risk, I am still in probation.
i have applied for new jobs, how the hell do I tell them about the disciplinary? I’m going to need to disclose it at interview stage but how?
has anyone been in the same situation and it worked out ok? Need some reassurance!
I am totally remorseful, it was a stupid mistake and I’m devastated I was so stupid.
I have applied for a few jobs that I think will suit me better but I’m scared they won’t take me on. They are jobs I am absolutely qualified for.
thankyou in advance!

Why would you need to disclose it?

I’m worried it will show on my reference

I don't think there's any rule at all that says you must disclose this; I'd certainly not be.

You've got to make a living, I'd really not advise bringing this up at all.

louderthan · 11/12/2024 19:24

I was suspended on full pay from a job, gross misconduct investigation. I resigned, got a temp job at somewhere I'd worked before, no refs needed. I then got another job and used temp job as a reference (worked for them on and off for 20 yrs); and the employer I had before the gross misconduct job for the second reference. I've been in this job for 6 years and had 2 promotions. All public sector.

LIZS · 11/12/2024 19:24

Is it likely to be gross misconduct if upheld? Will you be looking in a related or similar field?

I don't think there are either. Just go for it and don't say anything.

Hayley1256 · 11/12/2024 19:28

It shouldn't show on a reference

SilverDoe · 11/12/2024 19:29

Negative references are rare, it's much more likely they will confirm your dates. If you've only been in the new role a few months, is there any way you could just leave it off your CV altogether and say you've been taking a break since being made redundant?

It won’t be gross misconduct, more like unacceptable behaviour. I didn’t steal, it didn’t harm anyone, just not the behaviour that’s expected of my job role.

I’ve only been in job a few weeks, I had it in my head they could refuse a reference which in itself wouldn’t look good, I can’t leave it off really as new place will need my P45 then I will have to try and explain a 2 month gap in employment, I was already out of work for 3 weeks before I secured this job.
im just panicking; I’m so depressed, nothings gone right since September. :(

Thankyou, I can’t really risk resigning as I’ve been out of a job already, single mum and all that jazz.
if I had the money behind me I absolute would.

If I were you I wouldn't mention it, it's quite likely it won't appear on a reference. I'm not speaking from my own experience but do know people who have been on similar situations and it's been fine.

LIZS · 11/12/2024 19:41

It is quite possible they won't ask a two/three month employer for a reference if you have a longer period with previous one.

Thankyou, I’m just worried they will refuse a reference, I dont want to be in a position where I’m offered a job, hand my notice in then get the other job offer retracted cos they haven’t given me a ref, it unfortunately happened to one of my old colleagues this month, and I can’t afford to not have a job. I’m just worried about the whole situation really.

Hi OP, not sure about disciplinary specifically but everywhere I’ve worked they will only confirm dates worked/job title and nothing else. Bed references are rare nowadays because it opens up the employer to being sued by you (this is at least what I’ve been told) so I wouldn’t mention it

fivebyfivebuffy · 11/12/2024 19:41

I got dismissed managed out under performance after a decade
Got a new job but I did take any job while I was looking just to get another reference

I was in the previous job for 6 years and I’ll get glowing references from there. I should have been clever and left it off my CV but I’ve already sent it now! 🤦‍♀️

Thankyou, unfortunately one of my old colleagues got a job offer retracted this month as the employer she was with refused to give a reference. Which is why I’m panicking.

I’m absolutely happy to take any job at this point, the 2 I’ve applied for I’m really interested in and would love to do either. But it may be that it goes tits up and I have to find another way

I would recommend to anyone never to hand their notice in until the job offer is firm and references have been taken up.

That’s my plan, only have to give a weeks notice at the moment so I can extend that to make sure they have everything and it’s all confirmed. I was out of a job for 3 weeks and it was awful. I can’t do that again

Yeah but how do you do that when the new job contacts your current one for the reference?

If you are able to provide references from previous employers, this is excellent advice. However if they require a reference from current employer, I have never seen this requested and given before someone has handed their notice in. Is this sector specific?

I thought that, if I haven’t handed notice in then they get a ref request I’m screwed!

Lots of places just give tombstone references now due to fears around legal action for bad references so employers see it as more standard. I'd just say that it's their policy to give tombstone references and offer two other references to a new employer.

I had a disciplinary meeting in a job some years back, They decided I had a case to answer but I left as didn't want the stress and got an interim job using other referees.

Wasn't an issue.
