Raise a grievance with an ex employer?!

BL9877 · 19/07/2024 18:54

Hi all,

Just wondering if you're allowed to raise a grievance with an ex employer after being dismissed?! The entire process has been extremely lengthy no timelines were adhered to with no reasonable excuse for a delay. Can I still raise a grievance over how I've been treated even after being dismissed? (Unfairly!)

how long ago?

HermioneWeasley · 19/07/2024 18:56

You can but they’re not obliged to investigate. If you think you’ve been unfairly dismissed and have 2 years service you should lodge a claim with ACAS

you were fired… today?

quickoffthemark · 19/07/2024 18:57

how long had you worked there?

devildeepbluesea · 19/07/2024 18:57

How long ago were you dismissed? You could appeal against the dimissal and raise a grievance at the same time (if it’s for different issues).

Today!

Just appeal then, if you think it’s not done properly.

BL9877 · 19/07/2024 18:59

Just over 20 years (with a clean record) I am devastated and cannot believe this has even happened. It's been obvious since a change of management this is what they wanted.

How long have you worked there and that were the circumstances?

quickoffthemark · 19/07/2024 19:00

ok so you think you’ve been unfairly dismissed

in that case, get off mumsnet and start researching a solicitor to contact on mondsy

3 months and 1 day is the deadline.

we won’t know the circumstances

we will know the OP’s take on her dismissal

Solicitor Monday morning, OP. Good luck !

DinnaeFashYersel · 19/07/2024 19:02

OP you need to call ACAS for advice on whether you have a case and what to do next.

HermioneWeasley · 19/07/2024 19:13

DinnaeFashYersel · 19/07/2024 19:00

3 months and 1 day is the deadline.

You have to lodge your claim within 3 months of the dismissal and (unless it’s an exempted reason) you have to have 2 years service to bring a claim

BL9877 · 19/07/2024 22:30

What is that supposed to mean @quickoffthemark?

She means you haven't given any facts about the dismissal for anyone here to decide whether you have a claim for unfair dismissal

devildeepbluesea · 19/07/2024 22:35

If you’ve been dismissed you need to follow internal procedures until there is no more remedy. So, appeal your dismissal before taking to ACAS. They will tell you to appeal.

BL9877 · 19/07/2024 22:39

Thank you for the info. I think that's what I'm confused with - that I am unsure the order in which things go really. I don't trust the appeal process as that is internal and it's all so corrupt. Really upset and confused. I do appreciate it must sound shady but I'm fearful to go into details incase my employer sees this. Confused

but what if they do? if you are speaking factually, then nothing to worry about

Cheeseandpineapple123 · 20/07/2024 07:58

HR person here's

Appeal the outcome, they should have provided details of how to appeal and who to address the appeal to in your outcome letter.

The grievance procedure is not appropriate for a dismissal and if you are looking to try and raise a claim for unfair dismissal then you need to follow the appeal process first.

It would be helpful if you explained the reasons for your dismissal and what process they followed.

Sunnyandsilly · 20/07/2024 07:59

I think you need to give a high level overview of what’s happened and why. For folks to help.

unless it was gross misconduct, (although even then you’ve an investigation and time) then it’s not an immediate process. So the fact you’re so surprised says something is wrong here.

exactly that

and in any event, you are not the most objective person on the situation.

So what if they see it, they fired you, they are not your employer.

cryinglaughing · 20/07/2024 08:02

How stressful for you @BL9877 especially if the correct channels haven't been followed and you didn't see it coming.
I have no advice but good luck and I hope you find another job soon.
