Hello
so I’m currently signed off sick with a throat infection and work have seen me outside of my home taking my son to his rugby match, they have now launched an investigation and could end up in dismissal. A colleague videoed me and has since shared this where I work. Work have also announced to everyone that I’m under investigation. Are they allowed to do this? Many thanks

My nephew went to A&E for a sore throat because he couldn’t swallow.
Blood tests showed he had leukaemia but with your attitude he’d have stayed home until he was dying.

My Dad is currently in A&E with a DVT from chemo so you can lose the attitude.

Plenty of people here wasting time in A&E. OP is happy to go to her kids rugby match and pop along to A&E and wonders why she's being investigated.

This is all so typical of the "modern" UK we live in. Everyone expects to be "off sick" all the time on "full pay" but meanwhile other people have to do the work and carry the can.
The HR department have followed the right procedure here and its about time more of them started doing the same in my opinion.

@fr4zzledmum You can absolutely go on holiday while signed off sick. The GP has certified you as unfit for work, not as unfit for holiday. Could even argue it was a vital part of recovery/convalescence. This was tried at a recent tribunal and the employee won their unfair dismissal case over it. Your employer can NOT insist you convert your sick leave to annual leave instead.

Another HR professional here just agreeing with what the previous HR posters have already said. You are too sick to work and that has been backed up by your GP. Your work have no right to demand you spend it under lock and key, coming out only under the cover of dark and only then if your life depended on it. They don’t own you.

Your employers have behaved very badly, but to be fair 4 weeks + is an awfully long time to be off with a throat infection. Has the cause been diagnosed? Have you been on antibiotics?

@Dinoswearunderpants yes I went to a&e as advised by a gp! I was clearly not wasting their time I ending up on steroids and very strong antibiotics, and have been signed off work for nearly 4 weeks now, so yes I went to a&e nothing clearly!

Gosh. The ignorance is embarrassing. Have you ever heard of some of the serious causes of severe throat infection? People do end up in A&E for things like quinsy, for example. A nursing colleague nearly died and would have done so had her flatmates not taken her to A&E.

@endofthelinefinally My 3 year old’s key worker almost died due to a quinsy last year. Terrifying. My kid has been hospitalised with a throat infection in the past, too. We went to A&E. Call the police 😂

I’m a HR BP, 2 things here would worry me:
filming of you and distribution of footage around the business without your consent - that employee should be investigated
then, any manager investigating YOU when your GP has provided a sick note stating you shouldn’t be in work. Employers doing this are completely out of order.

Why was a colleague filming you? That really is disturbing. How did you see the video?
Surely its a breach of your privacy that the whole team and even some external people have been informed you are under review?

I would be getting all the legal advice you can on this and doing everything by the book. Clearly its not going to be an environment that you can go back and work and expect it to be an emotionally safe working environment.

Having to change jobs is going to cost you money and there may be questions over references too so think and get all the advice you need before acting.

Sounds very toxic it must be causing you so much stress.

She's been off work for weeks, she's recovering. One of my kids was admitted to hospital as an emergency with quinsy. Two weeks later, following surgery, they were out and about recovering.
