Hello
so I’m currently signed off sick with a throat infection and work have seen me outside of my home taking my son to his rugby match, they have now launched an investigation and could end up in dismissal. A colleague videoed me and has since shared this where I work. Work have also announced to everyone that I’m under investigation. Are they allowed to do this? Many thanks

Just wanted to say, keep your chin up, this is a horrible situation, and it must be rough to be right in the middle of it, but as you are grinding your way through it, step by step, you will reach some form of conclusion and a point where you can put it behind you. Their actions are abhorrent and I wish you all the best with your case.

So the outcome was a written warning, i
am appealing it tho as it’s all utterly ridiculous. They left me waiting for 45
minuets before they eventually decided on the outcome.

Don’t have the hearing notes yet, Iv done the request for breach of gdpr, I’m definitely appealing the decision as all I did was take my child to he’s game, out of work hours, it’s all joke, definitely of the lookout for a new job tho.

A written warning? On what grounds? You are currently signed off sick are you not? It’s none of their business what you did/where you went, your Fit Note states you are unfit for work at the moment. Defo appeal this!

Someone should remind them that when you are in a hole you should stop digging. They have already breached GDPR. Now they have added a written warning that is almost certainly unlawful to the mix. Stay strong. Make sure they pay for this.

Wonder if its worth a call to ACAS to see what their thoughts are....as PP said its really not appropriate to give you a written warning whilst your still off sick! ...... I would further go off with stress caused by work ... honestly OP I want to fight this with you 🤣

That's ridiculous.

Definitely appeal and tell them you're consulting with ACAS and/or an employment lawyer. Do a search of your area for employment law specialists that will do an initial free consultation.

Have they given you the written warning? Have you now seen the absence and disciplinary policies?

Are they outright accusing you of lying about being ill?

it’s a weird one because I guess to an outsider, it could be framed in a way that paints you in a bad light eg skiving as you’re well enough to go to sporting events. But they’d need solid evidence. What does the video show, you cheering and dancing or something?

I hope you're fighting this OP. If it's what you say it is then it's absolutely shocking practice. Are you part of a union and do you have legal cover with your home insurance? Was this a headteacher/hr department/governing body?

They can’t give you a warning for going to the match outside of work hours, presume they are basing the warning on it being evidence that you were indeed fit to work.

I’d therefore expect them to provide medical evidence refuting the evidence of your doctor that you are indeed unfit to work. I’d put this as the basis of your appeal. If you can bolster your own evidence of your illness I would add this.
