Final pay and salary adjustment

My contract was ended early. The company had given me a laptop but they have deducted this as a salary deduction from my final pay. I have not signed an agreement or agreed the amount that can be deducted from my salary. The email I have at the start says the laptop is mine. What can I do? Do I have to pay for something that I haven’t agreed to be taken off my salary?

I'd give it back and ask for the rest of my pay. How much did they deduct?

Danikm151 · 15/07/2023 08:03

I’d go through your contract with a fine tooth comb. There’s probably a clause that says if laptop isn’t returned within x days they will deduct the cost

FalconX · 15/07/2023 08:04

£900 from my last pay but I have an email to say that I can keep the laptop tho

When I took the job and was told that the laptop is mine to keep as a bonus

How long since you finished? Did you talk to anyone about returning goods. You must have known that all entry passes and laptops have a timeframe for being returned.

Depends on their policy, and what you signed when you took receipt of the laptop. But I would email back and contest it.

FalconX · 15/07/2023 08:07

The laptop isn’t in my contract. I only have an email to confirm that the laptop is mine to keep

I’ve returned everything else and that I had. I had shown that HR said that the laptop is mine to keep and was given to me. Thank you - I will try contest it

I finished 4 weeks ago and received my final pay slip last week

It’s unusual for a company to give staff a laptop when they start, but very normal to given a laptop for use while in the job. I PEX pec t there are lots of incidences where someone has had the laptop for 4/5 years and them when they leave told, you can keep it, it’s past it’s best.

How long had you worked there?

Echio · 15/07/2023 08:21

I work in a finance team with payroll - mistakes like this happen all the time even though they really shouldn't!! Most likely a miscommunication / misremembering of the facts by the time they sorted your pay.

Just get in touch with them and make it clear that you had it agreed that your laptop was provided free (attach proof of the email), so you are asking for reimbursement as it was a deduction in error, I definitely wouldn't go offering the laptop back at this stage unless they come back with alternative proof on it.

fruitbrewhaha · 15/07/2023 08:22

And what was the wording in the email re the laptop being yours to keep?

Was it a new laptop?

By the amount they have deducted it would appear it was a new high performance laptop, retailing at over £1k. Businesses aren’t going to give those away.

Amazing thank you so much 😊

As part of getting me to take the job they said that they will give me a laptop to keep as it was a contract role

I worked there for one year but as part of leaving my other role for a contract role they offered me a laptop to keep

I would assume that meant "to keep while you're contracted" as normally contractors use their own. Not to keep forever!

FalconX · 15/07/2023 09:08

I emailed to confirm that I would get to keep the laptop after the contract and the lady in HR wrote but yes

OP posts:
LuckOfTheDrawer · 15/07/2023 09:25

What do you mean - she wrote 'but yes'?

Sorry, it's the detail of the wording that's important here.

EarringsandLipstick · 15/07/2023 09:32

I've never ever heard of someone being given a laptop to keep.

If that were the case, you would as a minimum be required to pay BIK.

In terms of £900, that's the cost of a brand new high spec laptop, so that doesn't sound correct.

It's all very odd

burnoutbabe · 15/07/2023 09:36

A few people who left our small
Company did ask about keeping the laptop. Usually older machines so it showed up as £250 or so value as salary /bik to be taxed (then £250 removed as "already paid" ie laptop given to them.

So net cost was say £50 tax to get a £250 value laptop

But we agreed a taxable value in advance with the person so they knew the payroll affect.

Oblomov23 · 15/07/2023 09:48

Laptops devalue really quickly. BIK is hardly £900 a year later.

Oblomov23 · 15/07/2023 09:50

They can depreciate by 50-70% ij the first year!

Oblomov23 · 15/07/2023 09:48

And it wouldn't be even if new.

I've just signed off on new high-spec laptops for my team - €920 [so euro, not sterling] new.

If it was new a year ago, it's worth much less & the BIK value would be far less again of course

FalconX · 15/07/2023 11:55

Sorry that was typed incorrectly just feeling overwhelmed situation and how helpful everyone is. The email says yes that is correct - that is the exact wording on the email. They offered the laptop in addition so they can pay me less - that was my carrot

OP posts:
FalconX · 15/07/2023 11:57

How do I figure out my BIK - is there somewhere I can calculate it? Or ask them certain questions? Sorry I’m new to this

OP posts:
FalconX · 15/07/2023 11:58

How do I find out how much it depreciates? Is this up to the company?
