Hello, I was short-changed by my employer (paid for lesser hours) also they reported higher amounts of pay to HMRC.

Now, I sent an email to payroll about payment and the amount reported to HMRC which I got to know of through DWP. asked payroll to let me know the figures they reported to HMRC, and pay me the correct amount.

I just got an email from payroll saying I have no right to access any of my information with them and I replied I do as it is my own record I am not asking for another persons info etc

She replied saying she “studied payroll technician in University & have a knowledge of law and rights & have 18years of experience”.

Dont I have a right to request that they send me my own pay record (I have them in my bank statements but it seems they are making too many errors so what to be sure.) and the amount they reported to HMRC?

Can you explain a little more about what HMRC are saying is wrong with how the pay amounts are being reported

Regardless of whether you are being paid for the correct amount of hours exactly how is a different amount to the one on your payslip being reported to HMRC?

Where is the wrong figure coming from? Now it seems to be clear that this is incompetence rather than fraud how is it hapening?

@AllThatFancyPaintsAsFair the HMRC actually gave a detailed explanation in the doc sent to me which I won't be able to share here because is got some details I don't want in the public domain and the explanation is oh my, too complex for me to understand it. But the fact is that my bank acc payments are same as net pay on payslips, amount reported to HMRC is way higher that what is on my payslip 🤷🏽‍♀️

HMRC told me employer is got to correct the manner in which wages was calculated and the employer is saying to me that HMRC is wrong 🤦🏽‍♀️🙄😭😭😭 i am now like a bait between both parties because they can not agree on the way wages was calculated.

hours paid are lesser than the hours I have worked (which is something separate because my manager is working out the amount due to me)

I am going to submit an official complaint to HR this week (through my manager) because the person I have been emailing in payroll is saying she does not like my tone even though I was never rude. I have sent several emails asking

for written and verbal explanation of why they are convinced they are correct in their calculations and HMRC is wrong,

to be given the email of payroll manager or for the person I am corresponding with to confirm if he or she is the one

to give me the details of HR manager

But I have not got any answer to those questions even though have asked several times buy email

But the payroll person said she's copied HR into our emails recently and says they are aware and I said she should let them know I intend to take all othee steps if the matter is not resolved by going to a tribunal.

So, on sick leave from October 2021 to April 27th 2022 (long covid) went back to work after 28weeks of SSP. Can I go off sick and get SSP again from now (July). Which will be 12 weeks after SSP pay which wasted for 28weeks.

Yes I believe that’s the case.

what sort of company do you work for op? Is it a large organisation?

are you on a permanent contract and how long have you been there?

do you get a fixed salary? And do you get other payments such as extra hours/overtime?

Hello all and thanks to everyone who commented - all very much appreciated

Now I have written a grievance letter to HR threatening them with employment tribunal and that I will be pressing for compensation for all the inconveniences as a result of unlawful deduction of wages. They have replied asking to speak to me 1st informally and I have accepted to speak to the HR personnel.

Any tips on what to say?
I will obviously be asking for money owed to me, I want a record of hours worked and paid for from the payroll system, HMRC income report corrected, holiday pay for the time I have taken off since last week due to the stress of being short-changed. They refused my holiday pay but I have doctors sick note.
suggestions, opinions will be appreciated thanks a bunch

Ypu can't get holiday pay if you were off sick and holiday not approved though

If you put the question of approval to one side, you can get holiday pay when on sick leave. Normally it is only requested once someone is on nil pay.
The relevant case law is ECJ ruling Stringer & others vs HMRC.

I hope I get a reply to this because this thread's gone cold.

So work did work out how much they owe me and paid but was short changed again 🙄

I haven't worked for the company since July because they seems not to be taking it serious. I am on sick leave due to work stress

I wrote to work again and now they have someone looking into the matter and she said she will get back to me this week.

But I am wondering how to go about demanding/asking for compensation from them.

I have looked into going to an employment tribunal but haven't got the energy at all. I am currently deflated, dad and depressed from all the stress caused I already was suffering from long COVID and this whole incident just made things worse.

If they have paid you less than NMW you can report them to HMRC, but that will just get you the money that you are owed.

To get compensation you will need to show you have suffered a financial loss. So if you got bank charges as a result of being underpaid, cost of travel if you had to go into the office to specifically chase them for payment etc.

Someone else may be able to advise you better.
