Annual leave - return from ML + going part time

Just wondering if someone can check my maths!! Have name changed in case my boss works out it’s me Grin

So our holiday year this year runs 1 May 2021 - 30 April 2022. I am returning from maternity on 2 August, when I’ll be going down to a 4 day week, with Mondays as my non working day. I’ve been on statutory maternity throughout (no enhancement, if relevant). Standard allocation for full timers is 25 days plus BHs. My understanding is that my allocation is calculated as follows:

STEP 1 - during maternity. 3 months of usual allocation (so 25% of 25 = 6 days) plus all the bank holidays in that time (2 days) so total 8 days for this part.

STEP 2 - on return from maternity, 80% of full time. 19 days remain in this section of the year, and 6 bank holidays in this time = 25 days. 80% of 25 is 20 days. Because I’m not working Mondays I then subtract all the non-Monday bank holidays during that time, of which there are 2. So total for Step 2 is 18.

To get my total allocation until 30 April 2022 I then add those figures together so 8 + 18 = 26 days.

Is that right? I think it is but it seems weird that I’ve got more A/L days than I would get as a full timer despite spending a quarter of the year on maternity and going down to 4 days!!

You may find your employer requires you to work hours and use 365 days to pro data the year. However, you are roughly correct.

You will have more days left to take when you chose because not all BH fall on your working days. As Christmas and New Year change each year you entitlement can vary slightly from year to year.

Yup when I returned from my first maternity leave I had 8 weeks annual leave to take.

Amazing, thank you both. I’m pretty sure everything is worked out on days when pro-rating (vaguely recall from when I started midway through a year) but great to know the principle is right. We’ve had a bit of a childcare nightmare so very useful to have a bit more leave than I thought to try and plug a temporary gap!

I do 3 days a week and I’ve only got 10 days annual leave + bank holiday.

Sounds like you have been - if you're in the UK, minimum annual leave is 20 days and 3/5 of that is 12, so you should be getting 12 days annual leave at least (plus bank holidays).

@Redkey Conveniently for them I work Tuesday-Thursday so I don’t get the bank holidays.

They made me use 2 day during furlough and now I’ve got 8. I did query it at the time but they said it was right...

I just read through some emails - something about some of my leave having to be allocated against bank holidays so I can get the “8 days” as a part time worker.

You should get 5.6 weeks worth of leave so 3 x 5.6 = 16.8 days of leave. Bank holidays can be included in that figure or be on top of it. You would be entitled to ⅗ of leave and ⅗ of bank holidays.

I think you should get 17 days but you are getting 18 days...but happy to be corrected.

I actually just remembered the company policy is that we use 2 days of our annual leave for xmas, so those 2 have been allocated. Overall it looks like I’ve got 12 days, as 2 for Xmas & 2 for furlough have been deducted. Bank holidays I don’t get as I don’t work those days.

My full time holiday allowance was 25 days.

⅗ of 20 = 12 (20 is the minimum leave)
⅗ of 8 = 4.8 (8 for bank holiday days)
Total is 16.8 (same as above figure of 5.6 x 3)

You get the bank holidays pro rata whether you work any or not

Do you mean 25 + 8 bank holidays for full time?
That means you should get ⅗ of 33 days which is 19.8 days.

So, are you saying that despite working Tues-Thurs (and therefore not working most bank holidays in the year) - I am legally entitled to a full 19 days annual leave? I should just be able to book those as normal? Why are they saying 12? I’m so confused.

Yes you can't be penalised by being a part time worker so you get a pro rata amount of both bank holidays and annual leave.

When I worked pt my leave was converted to hours, not days, same for my bank holiday entitlement, it doesn't matter if you never work on a Monday, you still qualify for a bank holiday entitlement.

How many days leave have they given in total for the year? Basically you get ⅗ of the full time holiday entitlement plus ⅗ of the bank holidays entitlement if you work 3 days.

Then deduct any bank holidays that fall on your working days ( might vary from year to year) and what you're left with is your leave entitlement
