Part time hours and bank holiday Mondays

Chicchicchicchiclana · 13/01/2021 20:06

Hello, can someone advise?

I currently work part time (4 hours per day 4 days per week = 16 hours total). My days off are the weekends and one regular set day during the week.

I want to ask my employer if I can change my day off to Mondays.

Does that mean that my salary will go up slightly? So, some of my regular weekly days off will now be bank holiday Mondays which I will be paid for?

Does anyone understand what I mean? Even writing it down I'm getting confused.

There may be stuff going on with your colleague that you are not aware of and this can seem unfair to other staff.

Unfortunately HR would not be in a position to tell you either.

In my company, if you work 4 days a week, any week with a bank holiday you get 1/5 of your weekly hours off for that week with the bank holiday. Regardless of whether you work Mondays or not. If Mondays are your usual work day, it ends up you have to make up hours on the other days. So you work 8hours x 4 days, in a week with a bank holiday you work 32 hours less 1/5x32 = 25.6 hours. If Monday is a normal work day for you, but we're shut, you have to do 1.6 hours over the other 3 days to make up, although to be fair we're very very flexible.
If you don't work Mondays then you do your 25.6 hours over your 4 days

I have seen this system before but quite some time ago now.

Bonkers!

takingthebiscuit I manage the sickness and it is not the staff member asking for the A/L, they also think it is bonkers. I just need the answer so I am fair and equitable to all in the team.

vdbfamily · 23/01/2021 14:21

this thread has inspired me to Google NHS terms and conditions and because bank hols are added to stat holiday in NHS, you have to take them on the day or lose them.

Sorry, that is wrong link. I cannot link to the NHS terms and conditions but have forwarded it to myself at work to sort out on Monday.

OK so he can either be off sick or on annual leave, not both.

Not sure what days he was absent but the bank holidays were not all in the same week and Boxing Day was Saturday then there was an additional day for this as the actual Bank Holiday on Monday 28th.

If you are not contracted weekends or bank holidays which days was he actually absent due to sickness?

Kitkat151 · 23/01/2021 14:27

@FoxBaseBeta

Take Monday off. When I worked 3 days a week and had Friday off, my adjusted bank holiday 'allowance' didn't always cover all the BH Mondays so I had to dip into standard annual leave. My colleague who had Mondays off was rolling in holidays as she didn't have to use any BH allowance or annual leave to cover it, as it was already her day off. I'm not sure any of that made sense, but if I could choose my day off again, I would always choose Monday.
I have Mondays off....works put much better as most of bank holidays fall on a Monday.....so I can use my bank holiday hours whenever I like!
Higgeldypiggeldy35 · 23/01/2021 14:29

I'm in the NHS and I work Mondays and Fridays. They deduct my allocation of BHs of my AL allowance and because BH always fall on my working days I get a lot deducted. I would be about a week better off in AL if I worked Tues, wed, Thurs, instead.

Poppyseeds2 · 23/01/2021 14:30

@Dee1975 that’s how I thought it would work too if your work place is shut on bank hol it would mean you always get the day off so essentially it’s better to have a different week day off Confused

takingthebiscuits · 23/01/2021 14:31

Anyway, the NHS rule is no bank holidays are credited back if you are sick on a bank holiday.

Trying to find a link for you, here is a good one from an NHS CCG.

Part time hours and bank holiday Mondays
Groovee · 23/01/2021 14:34

I think it depends on your job. In my job, because I work Mondays I give my job share so many days back in a school year. Due to a few holidays being on a Friday, it means I work 2 days for her to make it up. Or else they take those days off my salary.

takingthebiscuits · 23/01/2021 14:39

@vdbfamily

There are only two possible bank holidays in the same week because you can only take Boxing Day once, Saturday is a non working day because your service is not open.

As PP mentions it can also depend on your job and service area, also whether you work fixed or flexible days for example, you would need to check relevant policies and contracts.

HR don’t always get it right!

takingthebiscuits · 23/01/2021 14:41

If you are under Agenda for Change, bank holidays are not credited back when off sick, as per link above.

How does it work if one person works Monday, Tuesday and Wednesday morning and another person works Wednesday afernoon, Thursday and Friday but both get 17 days holiday which ncludes bank holidays in the 17 days. Most Bank holidays are a Monday so Monday to Wednesday gets those Monday off, business is closed. Weds to Fri is off on a Monday anyway. Eg in 2021 there are 6 Bank holidays on a Monday and Tuesday and only 2 on a Friday. Should both colleagues get the same amount of holidays in their entitlement?

So you both work same number of hours per week on fixed days?
TroysMammy · 23/01/2021 14:47

Sorry for the crap typing, fat fingers, small phone.

TroysMammy · 23/01/2021 14:49

Yes bar 1/4 hour difference.

takingthebiscuits · 23/01/2021 15:14

Then you should have pro rata the same annual leave.

Some employers allow you to work different days instead of using annual leave on bank holiday weeks, if this is an option for you?

If not then yes the early part of the week will use their holiday entitlement up quicker as more bank holidays earlier in the week.

vdbfamily · 23/01/2021 15:45

Sorry to have commandeered the thread but my staff member was off whole of Christmas/ New Year period not odd days. I am now clear that the 22.5 hours should be deducted, like for everyone else in the team.

CoRhona · 23/01/2021 22:08

There is a job I do at work that I am not keen on which for me only falls on a Monday so I like bank holidays!

TroysMammy · 24/01/2021 09:32

takingthebiscuits excuse me if I seem to not be able to grasp this, figures are not my strongest skill. Eg we both work 144 days a year, we both have 17 days annual leave. My colleague working the first part of the week will have an extra 6 days off in 2021 as the business is not open on Bank Holidays so only works 121 days a year but as I work the end of the week I get 2 days off for Bank Holidays, so I work 125 days a year. Therefore my colleague will have 23 days off and I get 19 days off in 2021. Is this correct?

@TroysMammy are you NHS?

What you describe doesn’t sound correct if so.

On a Bank Holiday do you and or your colleague take annual leave or a day off and work your total weekly hours on other days in those weeks?

If you are a job share and work fixed days most likely you are taking annual leave?

If you work the second half of the week you have more opportunity to take your leave when you want, check your contract and workplace policies for your exact circumstances too.

You both work the same hours and should therefore have the same annual leave entitlement.

TroysMammy · 24/01/2021 10:55

takingthebiscuits my colleague has the day off, it's my rostered day off. She then only works Tuesday and Wednesday morning of that week and I work the rest of the week. She works 1 1/2 days. I work 2 1/2 days. I think it's unfair, ok I'm off anyway but I expect I don't get paid. I'm not sure if we get holiday pay on a Bank Holiday.

There was a massive cock up with holidays a few years ago. Then I worked every weekday morning so half day working was a full day holiday as it should be. My colleague who job shared with another until she left (I had her working pattern) both used to take their half day on a Wednesday as half a day holiday, not the full day as they should have. Therefore having loads of holidays. This was noticed by the Manager after 2 years. They only had to pay/work some back. The other colleague left because she didn't have as many holidays as she thought she should.
