Redundancy payment

Lovebug2020 · 28/08/2020 19:56

I got paid furlough today.

Received redundancy notice at 5pm. Last day of work is today.

I have not received any redundancy money. Monday is bank holiday and I’m sat here wondering when it’s going to turn up.

Nothing has been said about it being paid at a later date. What is the norm here???

I just want to get my money and run 😮

I'm someone with more experience can help, but I thought redundancyw as on paid after you'd worked there 2yrs. How long have you been there? Do you have a union? have you looked at the ACAS website?

RNBrie · 28/08/2020 19:59

How long have you been there? How long is your notice period?

There is a formal redundancy process that a company has to take, including informing you of redundancy and giving you a couple of weeks to discuss suggestions about how to avoid a redundancy situation. Then they need to confirm your redundancy and the start of your contractual notice period. Have they don't any of this? Have they told you not to come in next week?

Doingitaloneandproud · 28/08/2020 20:02

Were you an employee or contractor for the company, and have you worked there for over 2 years? They are meant to give a notice period for redundancy and as a pp said suggestions to avoid it if possible

trilbydoll · 28/08/2020 20:06

The norm would be you're given notice of a consultation period, length of which depends on the number of people affected, you'd all have meetings where you were given your score and you'd have a chance to disagree and then you'd be made redundant at the end of the consultation period. The money would depend on the timing of payroll - we made people redundant at the end of June but it was finalised until after payroll cut off so the payments were made in July payroll.

Lovebug2020 · 28/08/2020 20:27

Only employed 1 year but I’m owed 2 months notice and 3 weeks holiday at this stage.
Not part of union
Yes seen ACAS and followed their advice but please bear in mind the notice came at 5pm Bank holiday weekend and there is no financial statement. I was expecting to get this information today and it didn’t arrive.
They did a rush “consultation” in other words I didn’t get it done properly. Then I got the notice today. My notice Period is Pilon .
I am aware I have a potential claim but I was really just wondering about the date of payment when they have said nothing and not given a date.
I would have expected payment today as nothing has been agreed. Surely they should tell you when it will be paid or agree a date?
I got told a week ago I would be getting notice today so they had time to make payments 😮

Have you had your salary this month (presuming yes, as there are no further banking days in Aug)? If so, based on them giving you notice of redundancy today then I would anticipate your owed notice and holiday would be paid in the next payroll (whether that's weekly or monthly for you). It doesn't sound like you're entitled to a statutory redundancy payment as well due to your length of employment only being 1 year, but it depends on whether your company has any additional policies on that.

I'm sorry about how badly it was handled Sad

MyPersona · 28/08/2020 20:53

What would be the basis of your claim?

AriettyHomily · 28/08/2020 21:23

You don't have basis for a claim. Unfortunately you're not entitled to anything with under two years service unless they enhance the package.

vixb1 · 28/08/2020 21:34

Usually your PILON and holidays would be paid the next usual payroll. When were you next due to be paid? I'd expect you to have a letter summarising the outcome of your consultation and confirming the details.

LaurieFairyCake · 28/08/2020 21:53

I would expect you would get it all together at end of September

flowery · 28/08/2020 23:49

You’ll probably get it next pay day but you’ll need to ask them.

You haven’t said anything suggesting you may have any kind of claim, unless of course they don’t pay you your notice or holiday.

molifly14 · 29/08/2020 14:19

I suspect it'll come in September as payroll has already been finalised for August (for most places). Don't see how you have a potential claim as you don't have any employment rights until gets service unless you have a protected characteristic. Are you sure you're entitled to two months notice?

Lovebug2020 · 30/08/2020 20:27

Maybe I’m thinking too much but my employer waited until close of business on Friday to tell us about the redundancy notice. Am
I paranoid or would you say that was deliberate?
They made there choice on the Wednesday according to the timetable but didn’t say a word till 4:55 before a long bank holiday weekend!
I think that alone is out of order

Last thing on a Friday is not a good time to be delivering bad news, but it isn’t technically wrong and if you mean that is the “claim” you have, well it isn’t. Apologies if that is not what you meant and were just pointing out the unpleasantness of it, which I agree with.

I know of a company that announced a factory closure on the afternoon of the last day of working before the Xmas break. It's to protect productivity, but it sucks.
MadameBlobby · 31/08/2020 11:26

Jesus wept, banging on about a claim when you’ve only just finished work! Don’t be so bloody impatient. Ask them when it’ll be paid and if it’s not til the next pay run ask if they can do it sooner. What a drama over nothing.

MadameBlobby · 31/08/2020 11:27

As for the timing of the announcement perhaps not great employee relations but not in and of itself grounds for any action.

It’s not a nice thing to do but it’s legal and probably to stop any productivity issues.

Did they follow the acas redundancy procedure? As you are under a years service you should receive lieu and holidays owed in the next pay run.

ShellsAndSunrises · 31/08/2020 11:59

It does sound rubbish and I’m sorry that you’ve lost your job. Sadly because of your length of service; you’re not entitled to much, and they don’t seem to have broken any rules. I’d expect your payments to be made in Septembers payroll.

Do check with them tomorrow; though. I hope you find something else quickly Flowers

unmarkedbythat · 31/08/2020 12:02

DH was made redundant in July. His redundancy pay came separately to his final wage and holiday pay, about 10 days later.

Lovebug2020 · 31/08/2020 12:05

Thanks everyone for your feedback.
I have sought advice on all the issues and I do have grounds for a claim which I have double checked with my barrister.

@MadameBlobby - I have not been paid properly for months by my employer and I like else on here has bills to pay. It’s not drama so don’t be so rude when your not aware of all the facts .

What has your barrister advised you have a claim for?
Todaythiscouldbe · 31/08/2020 12:55

Wow, a barrister that not only works weekends and bank holidays but is also an employment expert. You have no grounds for a claim based on anything you have written here.

doriscartwheel · 31/08/2020 12:57

Claim for what? You should get any pay owed for hols etc in the next pay run. Not sure what else your trying to get for them
