My daughter and i have been cleaning a car showroom for over two years. Two weeks ago we had a letter left to say that they were thinking of getting contract cleaners in.They gave us two choices
1)to continue as we were
2) to work for the contract cleaners.
Both of these options mean our wages would be cut in half.We were given two weeks to decide ( even though after 5 days we were again asked if we had decided )My daughter and i came to the conclusion that we would give in our notice as we are not going to work for half the pay.So tonight i intended to leave our resignation letter.
We have always had our pay paid directly into the bank and had a wage slip ,but for the last few months they havent been leaving our slips for us.Last week we asked for our pay slips to be left up to date .Tonight when i went to put resignation letter on the desk there was another letter for us to say "there are no wage slips. The idea was that you were to supply a monthly invoice for cleaning services"I now havent left the resignation letter as i am so confused as to what is going on.We have been entitled to 20 days paid holidays ,they have our p45,wages go in bank, and just dont know what to do next. i did try and see the CAB but they were too busy and they dont make appointments.please tell me what i should do next.We still intend to give in a resignation letter, which is a month because we get paid monthly.i hope someone can advise me,Thankyou

do you have a contract with them mummylin?

TnOgu · 31/05/2007 22:22

I think NJ's advice is very helpful and can't add to that really but just wanted to post and show support

mummylin2495 · 31/05/2007 22:23

we dont have a written contract but it was verbal with the manager at the time.We dont pay tax because we dont come into the tax bracket. We have never been asked to supply any invoice, this is the first instance we have heard of it.The company was in two different buildings and then they merged into one and the owners son then became the manager of both. But we do have some previous wage slips and the circumstances are the same for the last two years.thanks for your help i will phone them tomorrow. The problem now is they stated they wanted a decision in two weeks which is up tomorrow.

is the situation hostile towards you or is the son still alright?

mummylin2495 · 31/05/2007 22:25

we can get all the evidence of wages being paid directly from the bank statements and also the wage slips we have already.

the son is fine ,he actually deals with the car sales, not the money issues ,i actually showed him the letter tonight and he dosent have a clue. But he does remember my daughter asking for her wage slips when she needed them when she was applying for a morgage

UPDATE !!! i phoned acas dead on 8am.they said to write our letter of resignation as we have already decided to leave and to state that we have wage slips from the past and as far as we are concerned we are employed by them .She said to ask again for the slips. She also said it makes no difference that we have no written contract. Also that they do not have to accept a months notice, they could say they only wanted 1 week. Then they said that if they have not given us holiday pay ,wage slips etc by the date we have requested ,go to a tribunal !The wages that the contract company would be paying is Half what we have been getting for the last two years, and if we decided we would stay they would pay us the same that they would pay contract cleaners ,so either way we would lose half our pay !

If you wish to apply to an employment tribunal, you must first raise a grievance. You can do this whether you are still employed by them or not.

It is clear from what you have said that you have been treated as employees by the company and they cannot now turn round and act as though you are self-employed. They will owe you for holidays, etc.

Take the letter they gave you to an employment specialist, as, personally, I would not have resigned. If they are making you redundant, then they will owe you redundancy pay. If they are not making you redundant, then they will have to follow employment procedures to terminate your contract.

[I know the computer is on in the study and I had to get a letter off the pile of junk in there and of course I look on here and now I'll get nothing done and my child will starve and my husband will leave me [when he gets back from Dublin] and I'm just a complete and utter MN junkie, heeeelp.

Yes, I would like to see the letter, thanks.
