Hi everyone
I just wanted to know if anyone's experience going to the employment tribunal.
How long it took from submitting your case?
How long It took to get court hearing date
An lastly how long it took to get a decision beginning to end?
I understand everyone's case is different but just needed some words of advice.
I am in the process of submitting a claim
Thank you

Tribunals will agree to reinstatement if the relationship has not totally broken down. It also makes things cheaper for your employer if they think you have a strong case as it stops them from having to compensate you for future lost earnings.

A reinstatement is ordered in less than 1% of cases. Also tribunals rarely award much in the way of loss of future earnings unless you are a high earner where the loss of job has a significant impact on your career. If it’s the sort of job where you could reasonably be expected to get an equivalent role you would be unlikely to get more than a years salary. You will almost never get costs.

My experience has generally been with higher earners but even then loss of future earnings that are awarded is limited. A settlement is highly likely to be the best option. Obviously we don’t know the details of your case though so you should take specialist advice.

I have first hand experience of this. It's been two years of hell but I won.

In terms of how long it takes. I left employment in June 2016. Employment tribunal was for 5 days in January 2018. Judgement held in chambers in March 2017.
Received judgement in May 2018. Preliminary hearing for settlement July 2018. 2 day court hearing listed in June 2019.
It's also cost me over 50K in legal fees.

Ta1kinPeace · 08/07/2018 16:30

but what did you actually "win"
what goals / aims / objectives were achieved?

Cupcakes12 · 08/07/2018 16:40

That was a very long time
But glad you got a positive outcome after everything

The tribunal was originally going to heard in June 2016 but my ex employer did everything they could to delay it to cause me greater financial stress. They succeeded by saying they wanted to bring 8 witnesses to the hearing and that a 4 day tribunal wouldn't be long enough. Their lawyers knew that to get another slot would be another 6months down the line, and this is what happened.
My claim was for Unfair dismissal, constructive dismissal, sexual harassment and sexual discrimination and lastly unfair treatment to part-time workers.
There were many times I thought about dropping my claim but my desire to get justice for being pushed out of a job I had succeeded in and put my heart and soul into for 15yrs saw me through.
Doing my witness statement was incredibly painful. This was by far the worst bit, so do prepare yourself for this.
Being cross-examined wasn't particularly pleasant either.
My only advice is to dig deep, put your emotions to one side and think about it very carefully.
If I can help you on any aspect or if you want to PM me then please do x

Good point. I've no idea. I know it's been done before.

Does anyone know?

MilkTwoSugarsThanks · 08/07/2018 22:04

App or mobile?

neverknowinglynormal · 08/07/2018 22:06

Yes, cross-examination is brutal. But better if you're not having to lie - the other side will lie and lie. That was the hardest part for me - seeing how blatantly my boss would lie - but they saw through some of it.

gamble1961 · 08/07/2018 22:42

I'm app. Cross tees?

gamble1961 · 08/07/2018 22:42

Sorry I meant I'm on an app what about you cupcakes?

gamble1961 · 08/07/2018 22:45

Neverknowinglynormal I agree re. Cross examination. I never had to refer to my witness statement though whereas witnesses on the other side did. I hope you too had a good outcome.

Cupcakes12 · 08/07/2018 22:53

Still not sure guys

I would definitely submit a claim and keep at it until they offer a reasonable settlement. It’s a tough road though so try not to take it personally.

Thank you
This is the plan
I have nothing to lose

You have £1000 to lose. You will also not get a reference if it goes all the way and you don't settle.

neverknowinglynormal · 10/07/2018 07:34

Refusing to give a reference because she had brought a tribunal claim or not settled would be victimisation, so I'm not sure that's correct, Ohtheroses

gamble1961 · 10/07/2018 18:31

Cupcakes have you found a way to PM? I'm here to help if you need it

OhTheRoses · 10/07/2018 20:38

OK, poor choice of words on my part. The OP will get a factual reference. It may not be pleasing. Depending on industry the tom toms may drum informally.

A settlement agreement means the reference is negotiated and agreed up front and there iz a remedy if there is any variation.

None of us know the ins and outs of this. My advice is to move on.
