I work 40hours a week and earn £11,000. This has gone up from £10,000 since I made a complaint to the shop owner about my salary.

I have reported her to the directgov email address I found (as have local businesses), nothing has come of this. I raised a grievance with my manager, on ACAS advice, and again nothing has happened. There are only 4 employees in the business, two cash in hand Saturday staff.

I don't know what else to do, I adore my actual job and sadly am looking for other things but after a year there its frustrating knowing how much I've missed out on. I would have left sooner but jobs seem to be thin on the ground here.

My mum has suggested emailing my MP. Does anyone have any advice? I know the owner will sack me if I keep going on at her.

I work in payroll but am not in work until next Tuesday.

You are over 21 I take it?

TonySopranosVest · 27/12/2015 15:21

I think ballet is right. I think you are undeclared. How does your salary go in? Is it by bank transfer?

msgrinch · 27/12/2015 15:22

Yes I'm 28, my tax code on my payslip is 1000L and from the conversation with my second job the manger said it would be a BR tax code with them but as Ive only started recently (12th) he's not due to pay me yet.

It might be worth you getting a statement of NI contributions.

msgrinch · 27/12/2015 15:24

Sorry X post. Yes it's bank transfer from the owners bank account, never on a set day, just as when she gets round to it around the end of the month.

balletgirlmum · 27/12/2015 15:25

That sounds right for a standard tax code & your second employer is also correct.

Does your payslip show any deductions? What are the gross & net amounts?

TonySopranosVest · 27/12/2015 15:28

Not out of a business account?

The tax code should be 1060L since April - so that's wrong for a start off.

NI wouldn't be payable at this low wage I don't think. Let me look that up.

balletgirlmum · 27/12/2015 15:30

Tony is correct sorry. It should be 1060 (lots of our workers have company cars etc which change things)

msgrinch · 27/12/2015 15:32

Gross is £833.33, net is £813.33. It does show NI deduction of £16.54.

OP posts:
balletgirlmum · 27/12/2015 15:34

So that's an annual salary of £999.96

balletgirlmum · 27/12/2015 15:37

Those figures don't add up

£833.33 minus a deduction of £16.54 should be £816.79 nett

msgrinch · 27/12/2015 15:38

This month she has increased my salary, my take home pay was £880. I haven't received a payslip yet (or for the past three months).

OP posts:
msgrinch · 27/12/2015 15:40

I was just thinking the same. It's hard to keep on top of things when we don't get our payslips each month. Just a sheet of them every 3 months or so. The new employee has been there for 2 months and not had a payslip at all.

OP posts:
TonySopranosVest · 27/12/2015 15:42

Making it up as she goes along!

Your net pay after the NI deduction should be £816.79 Confused Hmm

Get on the phone on Tuesday to HMRC and get your NI contributions from the last year. I will eat my hat if she's actually paying your NI - or if you're even registered as working there. It's appalling.

As ballet says, things have changed with PAYE now in that every month (or week depending on how the employer pays you) you have to report to them what deductions you have made in tax and NI. They know straight away what you owe them and you have to pay it by the 19th of the following month or they send nasty people to your company. Believe me, I've worked places who couldn't keep up with the PAYE/CIS deduction payments and HMRC do not mess about.

balletgirlmum · 27/12/2015 15:42

online.hmrc.gov.uk/shortforms/form/NIStatement

This might be a start to getting some info.

TonySopranosVest · 27/12/2015 15:43

X post!!

msgrinch · 27/12/2015 15:45

I'm going to call them first thing on Tuesday. This is ridiculous. I feel so stupid as you trust your employer to sort these things. Thank you all for all your advice. It's such a minefield to work out. I'm really angry.

OP posts:
balletgirlmum · 27/12/2015 15:46

My colleague nearly forgot to pay the PAYE because I was on holiday & Xmas. Luckily she remembered on 17th.

balletgirlmum · 27/12/2015 15:48

It's exploitation pure & simple.

antimatter · 27/12/2015 15:49

Looks lije they are paying you for 30 hours werk and not 40.
Have you got anywhere in paperwork stated how many hours is your week?

msgrinch · 27/12/2015 15:50

It's only because we have had time off over Christmas that I thought I'd have a proper look into it. Now it seems one thing after another is appearing. I really hope my second job can find some extra hours for me.

OP posts:
msgrinch · 27/12/2015 15:53

Yes I have my offer letter which states my hours etc. I keep on at them for my contract but it's like getting blood out of a stone.

OP posts:
TonySopranosVest · 27/12/2015 15:54

You should be angry! Don't berate yourself at all, how would you know?

Report, report, report. I'm just looking now to see if I can find any more organisations that might be able to help you.

TonySopranosVest · 27/12/2015 15:57

Oh, and just to set your mind at ease WRT to any NI deductions not paid on to HMRC - you will not be financially liable for them - she has essentially "stolen" that money from HMRC and will be treated accordingly.

balletgirlmum · 27/12/2015 15:58

I agree you need to report & it's annoying you hsvnt got anywhere so far.

It will affect your contributions history if you ever need to claim maternity pay or jobseekers etc. Plus your state pension of course.
