'The Scottish Government has stated that it accepts the Supreme Court ruling on the definition of a woman, however, last week the First Minister suggested a “domestic approach” would be taken.
Mr Swinney told LBC: “We have to consult on the recent guidance and consider the guidance that has come out of the EHRC, to ensure that we can apply that into our domestic approach and that is exactly what the Scottish Government will do.”'

Women are watching.

John Swinney accused of 'pandering to Nicola Sturgeon' over Supreme Court ruling

Another swerve, they got a million of them haven't they.

"She has demanded an explanation on what Mr Swinney means by a “domestic approach” and has sought urgent clarity on whether the Scottish Government intends to adopt a differing approach to the Supreme Court ruling."

I'd love to know what the hell he means by a “domestic approach” as well, my mind is boggled as to what that can mean. 🤔

We will have family style bathrooms, and we’ll all go wherever… no urinals…

CornishDaughteroftheDawn · 15/06/2026 15:31

That was also my first question. What on earth is a ‘domestic approach’?

How do you apply a ‘domestic approach’ to a workplace? Or does he mean domestic at the country level, in which both cases WTF does he mean?

Call me cynical but my guess is that a ‘domestic approach’ will not be good for women.

And women's prisons?

I'm very interested in their meaning of domestic approach too.

TheyAreLovelyLovelyPeople · 15/06/2026 15:38

Well it is just so very bloody wearing. We have to never let our guard down. Fuck sake, though.

Domestic approach sounds a bit downplay-y of the importance of the SC ruling. Hmmmmmm.

WallaceinAnderland · 15/06/2026 15:40

Who on earth is driving this. What a lot of time and money spent on men trying to get access to women and girls.

lornad00m · 15/06/2026 15:46

'domestic approach'??

= This is Scotland. We'll do what we like.

So we can expect more women to take the Scottish Government to court.

Meaning more wasting of tax payers money.

Because how can the SG possibly win if they're breaking the feckin' law. 😡

sohard · 15/06/2026 15:47

It means they’ll wait and see what England does and do something different. Guess we’d better start crowdfunding for more legal challenges. 🙄

Wishesandhorses · 15/06/2026 16:14

So FWS will have to go back to court..... AGAIN......

how long can they keep soaking the tax payers for these ridiculous cases before they just let women have some rights?

Wishesandhorses · 15/06/2026 16:15

Mind you, we'll have Burnham as PM any minute and he doesn't believe in women's or gay rights either. Or democracy.

I assume he means at a country level.

It rather implies that they think they’re exempt from following the guidelines around single sex spaces, despite the SC case which led to the judgment having been brought by women in Scotland.

Grammarnut · 15/06/2026 16:46

I suspect country has nothing to do with their approach at all. We'll see - or at least we will be looking over the border.

EvelynBeatrice · 15/06/2026 16:57

But this is the government the Scots voted in ..,,,

As I’ve said before a cynical person might think that the reason the SNPs/ Greens don’t value and are running down Scottish education is that stupid people vote for them ..,,,

PrizedPickledPopcorn · 15/06/2026 17:20

Oh, and mainly cleaned by women.

Turnout of c 50%.

Of that 50%, around 30% voted SNP.

It's not a resounding mandate.

Equalities issues are not devolved matters so it will be interesting to see what lattitude the Scottish government feels it has to interfere.

TheKeatingFive · 15/06/2026 19:00

Can anyone tell me why the Scottish government are so completely intent on pussong over women's rights?

Iamnotalemming · 15/06/2026 19:07

FFS. I hate that it is so necessary to watch our politicians like hawks to make sure they don't dismantle womens' rights under cover of darkness on a bank holiday weekend.

GCScot · 15/06/2026 19:20

Oh FFS.

I really can't see how Scotland can legally go against the Supreme Court ruling. But what else could a "domestic approach" possibly mean?

GCScot · 15/06/2026 19:22

Unless the Scottish government is going to re-interpret/ignore the EHRC guidance whilst still sticking to the Supreme Court ruling 🤔

NumberTheory · 15/06/2026 19:24

I'm wondering what they can actually do that would be legal. Do they have authority over building codes so could require buildings open to the public too, for instance, change all toilets to single occupancy cubicles? I don't think there is much that could be done about that but it would be hugely expensive for businesses. An alternative that might be more palatable would be mandating single cubicles alongside single sex provision.

AngleofRepose · 15/06/2026 19:32

Can we substitute "domestic" with "creative and unlawful?"

Wales take note-we're next! We'll want to do something creatively different from Scotland, unheard of in NI, and diametrically opposed to whatever approach England decides to take.

The complete lack of respect for law is stunning isn't it? Scotland and Westminster.
