Have there been any recent trans court cases brought by transpeople? And have they won or lost?

I suspect the answer is no, given it has been women who have needed to defend their spaces... but I'm interested if there are any recent ones, both here and overseas??

I've just had an update about that one (there's probably another thread on this somewhere, if so I apologise but thought it was worth a reminder here). The Federal court appeal against the original decision will be heard in Sydney on the 4th August, and Sall Grover is requesting further donations on Giggle Crowdfunding, as they've beefed up the legal team in the wake of the Supreme Court decision here and the one in the U.S.

Sal’s crowdfund needs more gardening as now the UN Court is involved. I forget the pathway to that.

However, look up Tasmanian Lesbians. They are in an unfortunate position nowadays.

I believe a TP (possibly 2) are in the process of bringing claims against 2 people who set up SEENs in the Civil Service.

Yes there was this one. The interesting feature of this case is that the facts were ‘agreed’. Which meant that the court did not need to decide whether or not the incidents (eg messages in a locker I think) actually happened.

The NHS lost and did not appeal. It is a first instance case so does not set a legal precedent.

My guess is that just the fear of being transphobic "won" lots of situations for them pre SC - but very very few actual UK cases so seldom tested?

There was a case brought by a transactivist (‘cis’ herself, with a trans-identifying child) but that was against a transwoman and was slung out in short order.

There was the Taylor v Land Rover employment tribunal in 2020.

Mind you, the claimant in that case self-identified as non-binary and genderfluid. I'm not sure how a similar case would turn out now, given the decisions in the Castelluci case.

From CrowdJustice it looks like it's still on track. Fully funded a couple of months ago. The claimant, Samantha Tempest, lost their application for anonymity. Should be entertaining if it goes ahead!

The case against Elspeth has been dropped but she has stayed on as an interested party. The claimant (Samantha Tempest) is suing Defra and trying to have the SEEN network shut down. Andreas' scase is separate but related. I think he and Elspeth were trying to have the cases joined together? The claimant in Andreas' case is not Samantha Tempest, as far as I know, as I think it had to have been someone from the same arms-length body as Andreas.

But yes, this should be an interesting (and entertaining) one. Although I don't want to sound flippant as it will have been hell for Andreas and Elspeth being dragged though this.

I can't remember where it was parked - were the lawyers going to do closing written arguments after the SC judgement? Case must surely be knocked out of the water, if there's any justification for a women-only section at all, then following the SC it has to be sex-based to take advantage of the same sex sports exceptions.
