It also needs to be broadcast until it gets changed that Scotland’s prison system needs to be clear and accurate about how many male prisoners are still in female prison estates following the Supreme Court judgement.

This policy needs to change. It shouldn’t be female prisoners who have to do it though. I am grateful that JK has offered to fund a case, but these women should not have to do this. Scottish parliamentarians should be forcing this change.

BunfightBetty · 25/05/2025 08:50

That there are still any men at all in Scottish women’s prisons, following Bryson, is mind boggling. I hope every woman prisoner having to put up with this sues the Scottish government. JKR may end up having to spend quite a lot, as it seems the Scottish government are as stubborn as they are sexist and stupid.

JKR has specified that the fund is to support strategic litigation. By this, I think her intention is to support cases that will create case law, and to undertake litigation in a logical order, so each addresses different loopholes/spurious claim until there are none left

I don’t think she would fund each and every female prisoner’s litigation - just one that is most likely to succeed. This would then set a precedence for others claims to go through more easily (or be settled out of court).

heathspeedwell · 25/05/2025 09:53

It said in the article that there are still at least four male murderers placed in prison with women in Scotland. Those poor women having to share spaces with some of the most violent men in society. And of course the point at which those men started to identify as women is largely irrelevant, they are still men.

Harassedevictee · 25/05/2025 09:53

@Brainworm I agree.

We all suspect who is funding the case against Fife Hospital and what comes across is that Sandie Peggie is a very decent person, a good hard working nurse who behaved reasonably. The impact of this one case on the NHS will be telling.

If Jayney Sutherly has a credible case for being denied parole for calling a TW prisoner he/him then it might be one the fund supports.

Did you read the bit that he was having sex with another female inmate? How can that go on in a prison?

It's absurd. Makes me wonder what else is going on. We need a prison officer to whistleblow.

He can’t listen to logic or reason because he’s ‘transed’ two of his daughters, and according to the eldest, bought her the appropriate drugs on the internet when she was 13. He’s not going to stand up and say it’s all a social contagion and no one is born in the wrong body is he? Not after he’s participated in this horrendous, ghoulish ideology with two of his children, because what would that make him?

I think JM and his wife spend an awful lot of time blocking out reality, otherwise they’d have to face their complete and abject dereliction of care towards their children.

It's unbelievable that someone who had both daughters being affected by what was at one time an extremely rare condition doesn't stop and think "there's something else going on here."

Did he trans them, or did they transition because it was the only way to get their father's attention, given his fixation on TRActivism?

I’m sure you’re right. I’m just not that convinced that the Scottish government will act without having a gun to their head. After all, why are there still any men at all in women’s prisons following the SC ruling?

The court cases are the gun to the head. There are still men in women's prisons because the prison service hasn't been sued over it yet. Litigation is the way to make institutions comply; that includes ScotGov.

That’s what I mean. That the Scottish government will drag its heels and kick and scream and force it to go through the courts for each and every micro-point of contention. Instead of just going ‘you know what, the gig’s up, the SC ruling means we can’t win these and the spirit of the law is clear, so we’re just going to go back to clearly separating by sex’.

A reasonable, sensible government, with an eye to the wellbeing of all its citizens and a sense of responsibility for how it spends public funds would do that.

But we know the Scottish government is none of those things.

And so far has stood in court making an absolute fool of itself, losing badly with appalling PR, and still stalked away shouting that it's right, everybody else is wrong, and gone on doing what it wants regardless.

I suppose at least with Fife NHS's attempt to stop public viewing it's starting to make them uncomfortable, thats the first step.

rebmacesrevda · 25/05/2025 12:26

Exactly. Individuals will have to take legal action against public institutions that do not comply with the SC ruling. At some point, we will reach a critical mass of lost court cases where ScotGov has to admit defeat. I don't know where the tipping point lies, but I've no doubt it's going to cost the public dearly. I would like to see ministers held personally accountable but I'll not hold my breath!

rebmacesrevda · 25/05/2025 12:31

We have an election next year, but the majority of voters don't know how badly the ideology has corrupted all our institutions. Most people believe in biological reality, but they think the trans thing is a weird niche issue and don't see how harmful it is to society as a whole. Lots if people still support independence, and will continue to vote SNP.

I don't know, but years ago he got into a spot of bother on Twitter for appearing to acknowledge the reasonableness of the GC position, and he dropped it. His fervently pro-trans phase started later. To me, this suggests that he reacted to what his child was saying.

RoyalCorgi · 25/05/2025 13:05

The Scottish Prison Service has been breaking the law since 2014. Until now, presumably, no woman has had the resources to mount a legal challenge. Absolutely heartbreaking, because if there is a group worthy of the description "most vulnerable", then women in prison probably fit the bill. The idea of locking these vulnerable women up with men, knowing that they are not in a position to challenge it, is nauseating.

To then prosecute a woman for referring to one of those men as "he" is beyond despicable. I'm glad that JKR is providing the financial backing for the woman to make a legal challenge.

And still it seems the SPS isn't going to follow the law and remove the men from women's prisons. They really are beneath contempt.
