Man who kidnapped and tortured women gets travel ban

'A man who abused vulnerable women in an underground chamber at his Highland home has been given the first worldwide travel ban to be imposed by a Scottish court.
Kevin Booth, who is in his 60s, carried out "punishment beatings" using whips, canes and riding crops at his Lochdhu Lodge in Altnabreac, a small community in Caithness.
A court ruling said he had carried out "a systematic course of conduct of acts of human trafficking and exploitation" over many years.'

Can anyone tell me why this man is not in jail? Why is he free to live in his giant castle with the fucking dungeon in it but not allowed to go on holiday?

Putting him in prison seems to me a much simpler way to stop him travelling and controlling his interactions with women. Or at least it used to be, now all he has to do is declare he's a woman, and they'll lock women up with him, save him the bother of making all the arrangements.

The police brought a CIVIL case against him, that's why.

Perhaps none of the victims wanted to be involved?

But it follows a civil court case - not a criminal trial. So Booth remains free.
So what's changed?
This court order imposes drastic limits on Booth's ability to traffic and exploit women in future.
He must tell police any time women visit his home.
He's banned from sponsoring visas for anyone travelling to this country.
So he can't bring women here from abroad.
And he's been forced to surrender his passport - so he can't travel overseas.
The focus is on controlling Booth in the years ahead - not on bringing him to justice for the suffering he's already caused.

The victims don't have to be involved to bring a criminal case. It is the police who take it to the CPS, and the CPS that decides whether to press charges - not the victims.

He's got a list of convictions and almost convictions for abusing women and children as long as the driveway to his fucking torture house... honestly don't give a flying fuck that this particular time was a civil case... he should be in jail regardless. Something is badly wrong that he isn't.

Those poor women must have been so terrified. I hope that they will be able to recover from what happened to them but I can’t see how . He deliberately targeted ‘economically vulnerable ‘ women. Vile vile man

It sounds as though they didn't have enough evidence to convict, but the bar for obtaining a travel ban is much lower?

So he's abused children in a school, trafficked and exploited (sexually and physically) numerous vulnerable women from abroad, assaulted an au pair and has received the massive punishment of 2 years for sexually assaulting the au pair? No charges for the abuse of children in the school he ran - where the pupils had to be put into care of the local authority once his abuse was discovered? And no criminal charges for trafficking and sexually / physically assaulting these women?

How has he got away with all this?

I wonder if it's that the procurator fiscal decided there wasn't enough evidence for a reasonable prospect of conviction under the criminal burden of proof (beyond reasonable doubt) and the police weren't happy and pursued the civil case (which only needs to prove on balance of probability) in a desperate attempt to limit his vile activities.

As far as I know it's essentially the same - procurator fiscal rather than CPS, but it's still not down to the victims to press or not press charges.
