That is a comment on a rapist’s ability to identify sex, not the law.

I agree that would have been a better tweet. It’s not helpful to be unclear when discussing legislation.

No, it’s not a comment on ability to identify sex. It is a comment if a man threatens a woman…as in he must perceive the person as being a woman, regardless of their actual sex

The point was to tell everyone that “this is not new” in terms of how hate crime laws are applied.

No idea. I don't know how the law works in Scotland re exceptions afforded to religious beliefs.

@Merrymouse there's only one way to find out. A bloke needs to don a burka and go there to pray. There's is a significant and growing minority of 'trans identified' men who like to larp as devout Muslim women, so it's going to happen at some point.

We are seriously considering moving back to England, @Myalternate - not just because of the SNP government's line on Trans rights and misogyny, but also because of so many other issues, including the tax regime here, and the SNP's utter ineptitude - under their government education and healthcare standards have plummeted, and the Hate crime law is just the latest in a line of ill-thought-out policies - the bottle and can return scheme, the Named Person legislation, to name but two more.

And who can forget the ferry fiasco? It took 3.5 years, from laying down the hull to completion to build the QE2. It has taken the shipyard and the Scottish government 9 years from the cutting of the first steel, and neither ferry is finished and in service yet.

It's a nonsensical tweet. What he's saying is that men who threaten rape to individual women are unlikely to know whether those women are actually male or not.

The perception element is not the issue with this tweet, and men who don't identify as women are also covered if it's in line with existing law. That's understandable but it's going to be vanishingly rare that people genuinely mistake an MTF or any other man for a female person.

The problem some people can see is that being a woman isn't about wearing a skirt or having long hair, it's about being female.

If all MTF trans people are considered "women" for the purpose of a misogyny law then "hate crime" in the extremely flimsy way it's applied in the HCA could be constructed about men who make little effort to "pass".

I don't think there's a lot of disagreement about the perception element. And it's not that difficult to think of a scenario where a TW might be the victim of a crime with misogynistic intent - passing could be a very low bar if the perpetrator is a drunk man on a dark night.

Doesn't change the fact that what Humza is saying about it is total bollocks, unless you buy into the TRA view that nobody can tell the difference. Which I don't think even he believes, though he thinks he has to say it.
