All new hate crimes legislation - JKR stands firm

As reported in the Daily Telegraph, the Hate Crime and Public Order (Scotland) Act at Holyrood in 2021 will come into force on April 1 after Police Scotland said it needed time for “training, guidance and communications planning”.
The legislation creates a criminal offence of “stirring up of hatred”, expanding on a similar offence based on racist abuse that has been on the statute book for decades.
Offences are considered “aggravated”, meaning they could lead to stiffer sentences, if they involve prejudice on the basis of age, disability, race, religion, sexual orientation or transgender identity.
Activists have already unsuccessfully attempted to have the author arrested for “misgendering” after she publicly called India Willoughby a male.

It's that pesky magical spirit essence again. First it decided what a woman was, now it decides what the law is.

The Misogyny Bill (scheduled to start its way through Holyrood before the end of 2024) includes anyone who may be confused as a woman, and almost certainly those that think they are a woman and clearly aren't. It doesn't - at the moment - cover the more serious misogynistic acts (rape, "rough sex" deaths, MVAWG) but focuses on white van man hurling abuse from his window. Don't be fooled by thinking this Bill will make up for sex being missed out of the Hate Crime Act, it won't.

It is unfathomable that this is happening for real right under our noses. I want to scream. Why anyone would allow either of these laws to be made just does not make sense. Why are the elected Women of these parties throwing away in effect women's rights?

The Misogyny Working Griup was led by Helena Kennedy KC, who does know what a women is but it was in her interest not to mention that. Even before the WG met she was in the press saying she was including TIMs in the remit.
Once the draft Bill hits Holyrood we should tell our MSPs what we think, particularly if you have one on the committee handling the Bill (still TBC but could be Karen Adam's Equality committee or the more sensible but busy Justice committee). Make noise.

So, if I was intending to avail myself of a Ladies restroom and a Transgender person already in there saw me abruptly but silently, turn on my heel and exit said Ladies restroom, would that warrant a report under those weird Hate Crime laws ?

It's a microaggression according to the University of Edinburgh so I can see how it could be utilised that way.

It's comforting to know that a harmless literally violent action that might save a woman's life can be reported as a microaggression and get said woman a visit from the Thought Police.
