Any definition of sex will have to comply with the GRA and the EqA, in particular this phrase, which acknowledges that sex can change. So, either you can change sex, or sex doesn't mean chromosomes - its definition is broader and context-dependent, as the law suggests.

You choose.

A person has the protected characteristic of gender reassignment if the person is proposing to undergo, is undergoing or has undergone a process (or part of a process) for the purpose of reassigning the person's sex by changing physiological or other attributes of sex.

It would merely confim a legal fiction.
A bit like a company being an artificial legal person.

The Gender Recognition Act itself has exceptions. For religion, and primogeniture. Which is why the wording is that a person has changed "gender", not actual sex. It's not the Sex Recognition Act. They are to be treated as if they were that sex. Bar exceptions in both the GRA and EA.

Im not saying it's what is happening now, and I'm not complacent at all about this case. But I do think it's important for the concept of "gender" to come under some legal examination at a high level. It's not women who have brought in a highly contested ideology under the radar.

That's just silly. Concrete reality doesnt have to 'comply' with the law. It's concrete reality, humans don't and can't change sex. If anything is going to change It'll be unclear phraseology in the law, it won't be whether humans can change sex.

But still, it's nice that you're looking forward to having clarity in the law.

People with the protected characteristic of gender reassignment have or intend to change sex. Please let me know the definition of sex you suggest which is compatible with this. If it's not, then there is no case.
