They can't help themselves though can they? 'For expressing beliefs about gender and sex' – do they mean, 'for stating facts about gender and sex'?

Ereshkigalangcleg · 26/01/2024 14:43

Yes.

RoyalCorgi · 26/01/2024 15:03

Holding a gender critical belief is protected, as are the belief that gay people are sinful, that marriage equality is wrong, and that there are differences in intelligence between races, as, I suspect, is climate change denial.

I'm fairly sure that climate change denial, a belief that marriage equality is wrong etc are not protected under the Equality Act, because they don't meet the Grainger test. Of course, if they constitute part of a religious belief, they would be protected, because religious belief is protected under the Act.

You can read more about the Grainger test, and what constitutes a protected belief, here:

Brilliant! Blinking brilliant article! :)

Mochudubh · 26/01/2024 15:23

I think belief in GI would fail on Criterion 4

(iv) It must attain a certain level of cogency, seriousness, cohesion and importance.

IANAL

TommyNever · 26/01/2024 15:24

I bet a certain young middle-aged man by the name of Owen is quietly seething somewhere!

Fixed 😄

RufustheFactualReindeer · 26/01/2024 15:34

Are you completely sure you want to say that believing that people have a sex and that cannot be changed is like racism

and climate denial 😳

A. How does climate denial mean you are a racist? When did that happen?

B. Does believing in something dad doesn’t believe in make you a racist? In which case I'm gonna need some clarification on dads stance on santa

C. Isn’t climate denial a denial of scientific facts?

Ha ha, at my age he does seem like a young man!

Holding a gender critical belief is protected, as are the belief that gay people are sinful, that marriage equality is wrong, and that there are differences in intelligence between races, as, I suspect, is climate change denial. However, there are many circumstances in which expressing or acting on those beliefs are discriminatory and grounds for dismissal - for example, misgendering or deadnaming transgender employees or clients.

Employers are going to have to be a lot more careful in future.

Equally, calling a gender critical person a hateful bigot or a transphobe or comparing them to nazis is discriminatory. I guess that must just burn you up, huh? Oh well 🤷‍♀️

Abouttoblow · 26/01/2024 15:52

Talcum X must be absolutely livid 😂

SinnerBoy · 26/01/2024 15:56

Perhaps he'll disappear in a cloud of self righteous pique and a cloud of Johnson's?

SinnerBoy · 26/01/2024 15:57

I must say, I'm halfway convinced that, erm, certain posters are actually doing some sort of reverse, by posting inaccurate rubbish, to be torn to pieces by irked Terves.

lanadelgrey · 26/01/2024 16:04

Given the presumed prevailing ethos at the Guardian, I would guess that the piece has been scrutinised word for word as disgruntled colleagues looked for reasons not to publish it so I am also guessing that points made in it do stand up and are inarguable

StephanieSuperpowers · 26/01/2024 13:40

Are you completely sure you want to say that believing that people have a sex and that cannot be changed is like racism, Jokers?

The protected belief I am referring to is that gender identity doesn't exist, in the face of the views of every reputable major psychological and medical body.

If your gender critical views cause you to misgender someone in the work place, or tell a GNC person they can't use a specific bathroom, it's likely to be harassment.

Who on earth said that climate change denial means you are a racist? It certainly wasn't me.

Climate change denial, IQ differences between races and a lack of belief in the existence of gender identity are all views which are not illegal but not supported by qualfied experts in those fields. It should be blindingly obvious that holding one of those views doesn't necessarily mean you hold other others.

RufustheFactualReindeer · 26/01/2024 16:15

oh I agree

but i think that everyone on here can see what you are doing…maybe accidentally?

its been commented on on other threads and this one…

DadJoke · 26/01/2024 16:16

@WolfFoxHare plenty of legal beliefs are bigotted, which is why the expression of such beliefs can be considered harrasment.

I'll repeat - I don't think that being gender critical makes your a racist.

Yep.

facts. facts and Facts. The TRAs don't get they are the flat earthers of the modern age.

edited to add- when it comes to science.

RufustheFactualReindeer · 26/01/2024 16:21

yes

you’ve said that…and i agreed

SinnerBoy · 26/01/2024 16:25

Well, perhaps not, but you conflated the two as equally abhorrent. Was that your intention?

BitingtheSkirting · 26/01/2024 16:26

Oh do stop making things up. Sure, some people see themselves as having a Gender identity. Some people have a religion. We all know that religion and gender identity are very real and very important to some people.

Doesn't mean everyone else has to agree.

soupycustard · 26/01/2024 16:26

I suspect that 'climate change denial' isn't protected under Equalities legislation. Any more than having an opinion on Volvos is. So I'm not quite sure where Dad's going with that. Or maybe I'm missing something - I'm fairly new to this board 😂

TheSlantedOwl · 26/01/2024 16:27

Let’s not get derailed by the misogynists on the thread.

This is great news, yet another sign that the tide is turning away from the oppressive bullshit the Graun has favoured previously.

soupycustard · 26/01/2024 16:29

I am very very shocked that the Graun (which used to be my newspaper of choice before it became ridiculous) has published this.
And it's definitely a very happy moment!!!!
