James Esses - UKCP settles

ArthurbellaScott · 11/12/2023 13:39

From Esses' crowdfunder:

'I am pleased to announce a very positive update. I have agreed a settlement with the United Kingdom Council for Psychotherapy (UKCP) in my claim against them.
Although I am not in a position to reveal the terms of settlement, I can say that I am extremely happy with them.
UKCP have also published a formal statement, which reads as follows:
'UKCP recognises that gender-critical beliefs (that sex is both binary and immutable) are protected under the Equality Act 2010. UKCP also recognises the validity of the professional belief that children suffering from gender dysphoria should be treated with explorative therapy, rather than being affirmed towards irreversible and potentially damaging medical intervention. Psychotherapists and counsellors accredited by UKCP are fully entitled to hold such beliefs and any discrimination against them on this basis, including by UKCP-accredited training organisations, is unlawful.’
^^
This is an extremely important statement, which I hope will ensure that what happened to me will never happen to another trainee therapist. It sends a clear message to therapeutic training course providers that if they discriminate against their students for believing in biological reality or child safeguarding, they will be held accountable.
With that in mind, although my case against UKCP has concluded, I will be continuing my litigation against the Metanoia Institute for expelling me from my Masters’ degree after I spoke out about concerns regarding gender ideology and child safeguarding.'

BACP have changed their position too on gender critical beliefs (thank you Maya Forstater) in their update in May 23 to their ethical policy.

The BACP document (2023) (GPIA 108) covers Equality, diversity and inclusion (EDI). The version updated in May 2023 does not refer directly to the key Forstater court judgement of 2021, but does make very clear that holding gender critical beliefs as a therapist is now protected under the law, and is compatible with the Equality Act 2010. Holding gender critical beliefs therefore does not conflict with the requirements of the BACP Ethical Framework (2018) (See: BACP, 2023: 11)
I got the quote above from the Critical Therapy Anecdote website.

This is brilliant news. Hopefully Metanoia Institute will now realise they also need to settle. Perhaps a few more men will now have the courage to stand up and be counted.

endofthelinefinally · 11/12/2023 16:13

And well done to all the people who donated whatever they could afford to pay for the legal representation for all these very important cases.

popebishop · 11/12/2023 16:14

This is fantastic news, particularly that the UKCP have now explicitly recognised medical invention as "irreversible and potentially damaging"!

Crankywiddershins · 11/12/2023 16:16

Excellent news. Another brick falls off the wall.

IcakethereforeIam · 11/12/2023 16:19

That's brilliant, cracking statement too. Not the mealy mouthed grudging semi-apology I'm used to reading.

Merry Christmas James, you've certainly made mine a little merrier 😊

Noshowlomo · 11/12/2023 16:19

Fantastic

CuriousAlien · 11/12/2023 16:21

Brilliant news. I hope Metanoia see sense.
It's absolutely mad to imagine the "affirmation only" approach has had such traction in psychotherapy when questioning, exploring and testing for evidence are cornerstones of therapy. Confirmation of the person's sovereignty as a human of course. But that applies to all humans and forcing affirmation on others is the complete opposite of that.

guinnessguzzler · 11/12/2023 16:29

This is absolutely huge news. Well done, James, that statement is just fantastic to have in black and white.

Froodwithatowel · 11/12/2023 16:31

Great news! Well done James! And thank you Maya Flowers

MrsOvertonsWindow · 11/12/2023 17:07

This is a bit like watching people wake up to the reality of being in an abusive relationship. Their world has been turned upside down to the extent that they accept the unacceptable as the norm and fail to ask for help / support as they think that only their abuser will be listened to.

So many organisations (especially schools and the NHS) need to take a close look at what they've been accepting as "normal" and realise that it's cloaking abuse / poor treatment & the removal of rights from women and children 😒

SinnerBoy · 11/12/2023 17:38

Arthurbella

You're absolutely right about just how important Maya's case was. This and other recent wins based on the precedent made from her result are clear evidence of it.

I bet part of the settlement was that they didn't fudge the apology!

LondonLass91 · 11/12/2023 17:41

That is a good clear statement from them actually - well done James - what a hero!

AIstolemylunch · 11/12/2023 17:42

WhereYouLeftIt · 11/12/2023 14:34

This is HUGE.

When Maya Forstater sought to have GC belief protected under the EA2010, I couldn't understand why she didn't just point out 'it's material reality'; but all the cases since then have been able to use that. It was very farsighted of Maya & team to take that line.

Facts aren't protected under the Equality Act but beliefs are, so the legal team didn't really have a choice but to present it this way even though it seems madness to most of us that reality is a belief!

AtrociousCircumstance · 11/12/2023 18:02

This is huge. Thank you James. Wow. 👏🏼

Sisterpita · 11/12/2023 18:02

Really good news.

SwishSwashSwooshSwersh · 11/12/2023 18:12

Very clear statement, should make it very clear to everyone

DameMaud · 11/12/2023 18:21

This is wonderful news!
