So what constitutes an "exceptional circumstance" then?

After much mature reflection the Scottish government have now decided that women's prisons are not the place for trans women with a history of harming women. Yay!

...except in "exceptional circumstances ". Not yay.

So can anyone please tell me, what are the exceptional circumstances in which it would be reasonable even to consider sending a rapist or abuser of women to a women's prison?

I can't think of a single one. Which makes me wonder why these weasel words were included at all. Is it to appease trans activists? Or to leave a loophole to carry on as normal? And why don't the press in Scotland ask?

I'm sorry but no-one should be sent to jail for non payment of tv license fines. These days you can opt out, if someone is not opting out then they're probably quite vulnerable. Lots of people can't just find £1,500. What happens if these women can't pay and get sent to jail to their children? Is the state really separating mothers from their children and putting the children in care because they can't afford to pay the - extremely high - tv license (fine)? That's literally insane and evil during a cost of living crisis.

Maybe this is a 'win' for women?

Maybe the 'exceptional circumstance' is something archaic such as if a prisoner is being detained or transported from A to B and there is no other cell in a male prison then they can be temporarily locked in a women's one or something and vice versa.

Ah for fucks sake, now they think TW in the male estate who are not safe enough to be moved to the women's estate should still be allowed to visit and learn about being a woman by mingling with women, with a view to maybe a phased transition as they become more safe by picking up womaning skills.

“Exceptional circumstances” is to limit the stick they get from TRAs but salve their conscience. One of the problems is that everyone down the line will also want to limit the stick they get from TRAs, which will mean a string of buck passing decisions culminating in highly unsuitable dangerous and controlling men (yes, I know there shouldn’t be any) in women’s prisons.

It is true that disproportionate number of women are prosecuted for this 'crime', which shouldn't be a crime at all. But hardly anyone is now sent to prison for this (but the number should be zero).

The discussion should be about why this is a crime at all, and why they are targeting people who are obviously poor.

Unlike the non-payment of utility bills and parking tickets, which are treated as civil matters, those who refuse to pay the television licence receive a criminal record and the details can show up on an enhanced Disclosure and Barring Service (DBS) check.

It should be treated the same way as these other charges.
