Teaching gender identity in schools

DH is a governor in a local secondary school. Today he went on a learning walk, which included a visit to a Y10 Ethics class where the children were being told that being a ‘girl’ or a ‘boy’ was not something that could be determined at birth.
Is this even legal?

I've just come off an NEU meeting about LGBT+ inclusion and it was all the usual arguments: Equality Act misrepresented as including gender identity; 48% of LGBT+ students have attempted suicide; we must affirm new names and pronouns and provide gender neutral toilets; we will continue to do so even if the government tells us not to. These teachers will not be teaching that gender identity is a belief any time soon.

It's really worrying that the NEU are supporting teachers to do things that could ultimately get them fired.
I hope they've got some really good lawyers at hand to represent teachers that spout this nonsense and end up in court. Utterly ludicrous!
