Judgement in Mermaids v Charity Commission tribunal expected in days

This is the case where Mermaids challenged the Charity Commission's decision to give charitable status to the LGBA.

Don't have any more detail at the moment, but thought you'd all be interested. It's been a four month wait already.

I really think they cocked up the management of this case. There should have been a preliminary hearing on standing and then everything else followed on (or not) from there. Would have saved a lot of time and money.

Yes, LGBA argued for that at the start didn't they?

It's a shame that so much time and money was wasted going about it this way, but I suspect draining LGBA was what the spiteful fuckers at Mermaids and GLP intended.

I think that was definitely their tactic, @yourhairiswinterfire . Hoping that they would bankrupt LGBA and that would be the end of it.

I wonder how long the CC will take to publish their report into MM, cos that will be something to see?

Is it just my reading of this but this seems aimed far more at one party than the other here.....

The statements out out by both charities already differ in their tone I think.

I read that as both a warning and an assurance actually.

It is saying that it doesn't think LGBA has contravened the behaviour requirements. And perhaps warning MM to be careful, and LGBA as well, not to fall short of that regulation.

Mermaids seem to be saying that they would have won. If the decision had been different. And that casts doubt in LGBA. And actually the judges agreed with them. But they lost. But they would have won really, in different circs.

FFS.

They would have won, if they hadn't lost. No shit eh, but it seems fairly typical of their line of reasoning! 👀

Reading the judgement, it does not look good for the good law project reputation. The arguments in favour of mermaids case weren’t strong and any honest lawyer would have told their client chances were very slim based on the set of facts presented in advance of going to court. The only winners in this are the finances of legal firms. I’m really surprised that anyone actually felt that was a good enough argument to win and didn’t recommend backing down before it got to court.

Trans group Mermaids loses bid to have gay rights charity shut down
The charity, which itself is facing a Charity Commission investigation, had claimed the LGB alliance was a front for transphobia

Incudes:

"Lawyers representing Mermaids claimed that the LGB Alliance had sought to undermine trans charities but Karon Monaghan KC, representing the defendant said that Mermaids efforts to get the charity struck off were “profoundly homophobic”.
She said that during the hearing, Mermaids had suggested that words like sexual orientation, sex-based rights, and lesbian, gay and bisexual were “used to signal position against trans rights”.
“This is deeply offensive, and it is profoundly homophobic, it is again the love that cannot speak its name,” Ms Monaghan told the tribunal.
She said that if that is the “stigma” attached to those words “it pushes same-sex attracted people back into the closet”.
A Mermaids spokesperson said: “We are taking legal advice on whether to appeal the finding on standing. In the meantime, our focus remains on channelling all of our energies into the urgent, critical challenges facing trans young people today.
“This includes demanding access to timely healthcare and robustly challenging forthcoming trans guidance for schools which, if reports are true, could have devastating consequences not only for trans children and young people, but any young person who doesn’t conform to gender norms.”
Separately to the tribunal, Mermaids is subject to an investigation by the Charity Commission which opened a “regulatory compliance case” after an investigation by the Telegraph revealed safeguarding “red flags” in its dealings with children.
Iain Steele KC, representing the regulator, had argued it was up to the tribunal to decide on all the information which had come to light whether the LGB Alliance should keep its registration.
However he said that just because the charities disagreed was not a reason to strip the LGB Alliance of its status.
The case was unusual and the first of its kind in the UK. Challenges to Charity Commission decisions are usually prompted by allegations of financial abuse or mismanagement, but this case required the judge to consider whether the purpose of LGB Alliance is “exclusively charitable for the public benefit”"

Mermaids action just sums up the whole TRA movement. Right from the first article I read a decade ago, where men were actively and proudly invading women's toilets and changing rooms, to five years ago where a senior female pediatrician was banned from her own childcare conference by TRAs, to this year (Adam Bryson, Austin Killips, Dylan Mulvaney, Mika Minio), all I see is "spite".

And so we see it here, in its revealed mendacity and pure aggression. Mermaids spitefully looking to put a charity out of business, maximum damage the aim, damn the consequences.

As each negative episode logs, my attitude hardens. More than ever, this is a zero sum game. The TRAs have brought this on themselves.

More than ever, I've lost faith with all politicians, save the few MPs who are unafraid to call this anti science and anti humanist movement out (Rosie, Miriam, Kemi, Jo, and some men I hope).

I hate the idea of LGBA having had to throw £250k on this raging bin fire, but this toxicity is even more visible than ever.

Whatever happened to my rational and humanist world? When did it stop spinning?

Because as we all know when it comes to matters of law it is feelingz and emotions that should be the guiding principles that determine outcomes. Not statute , legal precedent or considered judgement.

So pleased with this result. As other PPs said, the issue of standing should have been dealt with first, but at least we all got to see the somewhat astounding statements made by Mermaids and their supporters.

I think Duncan (@DuncanHenry78) has captured it:

'Mermaids, you do not have standing. You do not get to decide what other people think. You do not get to interfere with everything your ideology doesn’t like. You don’t understand it because you don’t get this fundamental point.'

Something I especially like about this outcome is the picture of the two LGBA, middle-aged lesbians, Kate and Bev, who were at the forefront of this case.
